  1  1    Section 1.  Section 123.49, Code 1999, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  5.  A person who is under legal age shall
  1  4 not enter or remain in a premises licensed for the sale or
  1  5 serving of alcoholic beverages for consumption on the premises
  1  6 except for the following purposes:
  1  7    a.  To perform work in the regular course of the person's
  1  8 employment within a licensed premises by a liquor control
  1  9 licensee or wine or beer permittee.
  1 10    b.  To consume a meal served within a licensed premises.
  1 11    c.  To attend a social function that is held in a part of a
  1 12 licensed premises where alcoholic beverages are not sold.
  1 13    Sec. 2.  Section 123.50, subsection 1, Code 1999, is
  1 14 amended to read as follows
  1 15    1.  Any person who violates any of the provisions of
  1 16 section 123.49, except subsection 2, paragraph "h", or
  1 17 subsection 5, shall be guilty of a simple misdemeanor.  A
  1 18 person who violates section 123.49, subsection 2, paragraph
  1 19 "h", commits a simple misdemeanor punishable as a scheduled
  1 20 violation under section 805.8, subsection 10, paragraph "a".
  1 21 A person who violates section 123.49, subsection 5, commits a
  1 22 simple misdemeanor punishable as a scheduled violation under
  1 23 section 805.8, subsection 10, paragraph "c".
  1 24    Sec. 3.  Section 805.8, subsection 10, Code 1999, is
  1 25 amended by adding the following new paragraph:
  1 26    NEW PARAGRAPH.  c.  For violations of section 123.49,
  1 27 subsection 5, the scheduled fine is fifty dollars.  
  1 28                           EXPLANATION
  1 29    This bill prohibits persons under the legal age or 21 years
  1 30 of age from entering or remaining in a premises licensed for
  1 31 the sale or serving of alcoholic beverages on the premises
  1 32 except for the following purposes:
  1 33    1.  To carry out their employment duties for a liquor
  1 34 control licensee or beer or wine permittee as otherwise
  1 35 authorized under Code chapter 123.
  2  1    2.  To consume a meal served within the premises.
  2  2    3.  To attend a social function which is being held in a
  2  3 portion of the licensed premises where alcoholic beverages are
  2  4 not sold.
  2  5    A person under legal age who violates the prohibition on
  2  6 entering or remaining in a premises licensed to sell or serve
  2  7 alcoholic beverages for consumption on the premises commits a
  2  8 simple misdemeanor punishable as a scheduled violation under
  2  9 Code section 805.8, subsection 10, paragraph "c".  The fine is
  2 10 $50.
