1 1 Section 1. Section 716.8, Code 1999, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 1A. Any person who knowingly trespasses
1 4 upon the property of another while in possession of a
1 5 dangerous weapon, as defined in section 702.7, commits a
1 6 serious misdemeanor.
1 7 EXPLANATION
1 8 This bill creates a new serious misdemeanor offense for
1 9 knowingly trespassing on the property of another while in
1 10 possession of a dangerous weapon.
1 11 Current law does not contain a penalty enhancement for a
1 12 person who commits simple misdemeanor trespass on the property
1 13 of another while in possession of a dangerous weapon.
1 14 A serious misdemeanor is punishable by imprisonment not to
1 15 exceed one year and a fine of at least $250 but not more than
1 16 $1,500.
