1 1 Section 1. NEW SECTION. 727.8A CRIMINAL VOYEURISM.
1 2 A person who visually observes or records the activity of
1 3 another person by any means commits a serious misdemeanor if
1 4 all of the following criteria are established:
1 5 a. The person has no right or authority to visually
1 6 observe or record the activity of the other person.
1 7 b. At the time that the visual observation or recording of
1 8 the activity is made, the other person is in a dwelling or
1 9 occupied structure.
1 10 c. The other person has a reasonable expectation of
1 11 privacy.
1 12 d. The other person has not consented to being visually
1 13 observed or recorded.
1 14 EXPLANATION
1 15 This bill establishes a new serious misdemeanor offense of
1 16 criminal voyeurism. The offense occurs when a person visually
1 17 observes or records the activity of another person without
1 18 right, authority, or consent and the other person is in a
1 19 dwelling or occupied structure and has a reasonable
1 20 expectation of privacy. A serious misdemeanor is punishable
1 21 by imprisonment not to exceed one year and a fine of at least
1 22 $250 but not more than $1,500.
