1 1 Section 1. NEW SECTION. 257.13 ON-TIME FUNDING FOR
1 2 INCREASED ENROLLMENT.
1 3 1. If a district's actual enrollment for the budget year,
1 4 determined under section 257.6, is greater than its budget
1 5 enrollment for the budget year, the district may submit a
1 6 request to the school budget review committee for on-time
1 7 funding for increased enrollment. The school budget review
1 8 committee shall consider the relative increase in enrollment
1 9 on a district-by-district basis, in determining whether to
1 10 approve the request, and shall determine the amount of
1 11 additional funding to be provided if the request is granted.
1 12 An application for on-time funding must be received by the
1 13 department of education by October 1. Written notice of the
1 14 committee's decision shall be given through the department of
1 15 education to the school board for a district.
1 16 2. If the school budget review committee approves a
1 17 request for on-time funding for increased enrollment, the
1 18 funding shall be in an amount up to the product of one-third
1 19 of the state cost per pupil for the budget year multiplied by
1 20 the difference between the actual enrollment for the budget
1 21 year and the budget enrollment for the budget year. The
1 22 additional funding received under this section is
1 23 miscellaneous income to the district.
1 24 3. Moneys appropriated by the general assembly for
1 25 purposes of this section shall be paid to school districts in
1 26 one lump sum within thirty days of notification by the school
1 27 budget review committee of approval for on-time funding for
1 28 increased enrollment for a budget year. If the requests
1 29 approved by the school budget review committee exceed the
1 30 appropriation made for purposes of this section, the payments
1 31 to school districts receiving approval for on-time funding
1 32 shall be prorated such that each school district approved for
1 33 on-time funding shall receive an amount of on-time funding
1 34 equal to the percentage that the on-time funding to be
1 35 provided to the district bears to the total amount of on-time
2 1 funding to be provided to all districts receiving approval.
2 2 4. If the board of directors of a school district
2 3 determines that a need exists for additional funds exceeding
2 4 the amount provided in this section, a request for
2 5 supplemental aid based upon increased enrollment may be
2 6 submitted to the school budget review committee as provided in
2 7 section 257.31.
2 8 5. If a school district receives a budget adjustment for a
2 9 budget year pursuant to section 257.14 and also receives on-
2 10 time funding for increased enrollment under this section, the
2 11 funding received under this section shall be reduced by the
2 12 amount of the budget adjustment for that budget year.
2 13 6. There is appropriated from the general fund of the
2 14 state to the department of education for the fiscal year
2 15 beginning July 1, 1999, and for each succeeding fiscal year,
2 16 the sum of four million dollars or as much thereof as is
2 17 necessary to pay additional funding authorized under this
2 18 section.
2 19 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
2 20 immediate importance, takes effect upon enactment for the
2 21 purpose of computations required for payment of state aid to
2 22 school districts for budget years beginning on or after July
2 23 1, 1999.
2 24 EXPLANATION
2 25 This bill provides that school districts experiencing
2 26 increases in enrollment may submit a request to the school
2 27 budget review committee for on-time funding for new students
2 28 by October 1 annually. The school budget review committee
2 29 shall determine whether, and to what extent, a request shall
2 30 be granted on a district-by-district basis. If a request is
2 31 approved, the funding shall be in an amount of up to the
2 32 product of one-third of the state cost per pupil for the
2 33 budget year multiplied by the difference between the actual
2 34 enrollment for the budget year and the budget enrollment for
2 35 the budget year.
3 1 The bill makes an appropriation from the general fund of
3 2 the state to the department of education of $4 million
3 3 annually, payable to school districts in one lump sum within
3 4 30 days of notification by the school budget review committee
3 5 of approval for on-time funding for increased enrollment for a
3 6 budget year. If requests for on-time funding exceed the
3 7 appropriation available, school districts with approved
3 8 requests shall receive prorated payments. School districts
3 9 may request supplemental aid above and beyond amounts received
3 10 for on-time funding pursuant to Code section 257.31. The bill
3 11 would become law upon enactment and remains in effect until
3 12 the repeal of Code chapter 257 on July 1, 2001.
