1 3 (COMPANION TO LSB 7268SS BY DRAKE)
1 4 A House Concurrent Resolution requesting the state
1 5 department of transportation to review federal
1 6 outdoor advertising bonus program restrictions on
1 7 signing and advertising adjacent to the interstate
1 8 highway system and to make recommendations to the
1 9 general assembly.
1 10 WHEREAS, Iowa has complied with the federal outdoor
1 11 advertising bonus program restrictions on signing and
1 12 advertising adjacent to the interstate highway system
1 13 set out in Title 23 of the United States Code for over
1 14 30 years; and
1 15 WHEREAS, the outdoor advertising bonus program
1 16 restrictions and the implementing regulations
1 17 unreasonably restrict advertising and billboards to
1 18 locations in commercial and industrial zones traversed
1 19 by segments of the interstate system within municipal
1 20 boundaries as they existed on September 21, 1959,
1 21 where the use of the property adjacent to the
1 22 interstate system is subject to municipal regulation
1 23 and control or where the property on September 21,
1 24 1959, was zoned for industrial or commercial purposes;
1 25 and
1 26 WHEREAS, the United States Department of
1 27 Transportation refuses to allow Iowa to update the
1 28 boundary restrictions from the September 21, 1959,
1 29 restrictions; and
1 30 WHEREAS, for almost 20 years the federal government
2 1 has failed in its obligation to provide outdoor
2 2 advertising bonus program payments to states for
2 3 advertising control under the federal law; NOW
2 4 THEREFORE,
2 5 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
2 6 SENATE CONCURRING, That the state department of
2 7 transportation is requested to review the federal
2 8 outdoor advertising bonus program restrictions on
2 9 signing and advertising adjacent to the interstate
2 10 highway system as set out in Title 23 of the United
2 11 States Code; and
2 12 BE IT FURTHER RESOLVED, That the state department
2 13 of transportation should submit findings and
2 14 recommendations based on its review of the federal
2 15 outdoor advertising bonus program restrictions to the
2 16 general assembly by January 1, 2001.
