  1  1          HOUSE CONCURRENT RESOLUTION NO.     
  1  2                  BY  MARTIN and TAYLOR
  1  3 A House Concurrent Resolution encouraging Congress
  1  4    to rescind Health Care Financing Administration
  1  5    rules requiring onerous home health agency 
  1  6    reporting.
  1  7    WHEREAS, rules recently promulgated by the Health
  1  8 Care Financing Administration (HCFA) of the United
  1  9 States Department of Health and Human Services
  1 10 requiring Outcome and Assessment Information Set
  1 11 (OASIS) assessment and follow-up reports for all
  1 12 patients of Medicare-certified home health agencies
  1 13 and health departments, whether or not the patient is
  1 14 a recipient of Medicare; and
  1 15    WHEREAS, the OASIS system requires an 18-page
  1 16 initial assessment which must be completed by a
  1 17 registered nurse, and a 13-page follow-up assessment
  1 18 which is required to be completed every sixty days;
  1 19 and
  1 20    WHEREAS, the requirement for computer software
  1 21 necessary for preparation and transmission of the
  1 22 OASIS system assessments and reports is essentially an
  1 23 unfunded federal mandate; and
  1 24    WHEREAS, the HCFA requirement necessitates costly
  1 25 reporting for patients who receive services not paid
  1 26 through Medicare and the reporting is duplicative of
  1 27 existing assessment and reporting requirements; and
  1 28    WHEREAS, in the small-scale home health care
  1 29 organization environment in Iowa, it is not feasible
  1 30 to provide services through separate organizations
  2  1 based upon whether the patient is a recipient of
  2  2 Medicare; and
  2  3    WHEREAS, the HCFA rules would result in Medicare-
  2  4 certified organizations only providing services to
  2  5 recipients of Medicare, thereby reducing the
  2  6 availability of preventive home services to older
  2  7 Iowans who are not recipients of Medicare, increasing
  2  8 in-hospital admissions and Medicare costs, and
  2  9 increasing nursing home admissions and Medicaid costs;
  2 10 and
  2 11    WHEREAS, OASIS appears to be solely a research
  2 12 project of HCFA, totally unfunded by federal sources,
  2 13 and accomplished with loss of funds by reporting
  2 14 agencies and loss of services to older Iowans; NOW
  2 15 THEREFORE,
  2 16    BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
  2 17 SENATE CONCURRING, That the Congress of the United
  2 18 States is encouraged to amend the OASIS system
  2 19 requirements to apply them only to patients who are
  2 20 recipients of Medicare and not to all patients of
  2 21 Medicare-certified home health agencies; and
  2 22    BE IT FURTHER RESOLVED, That the Chief Clerk of the
  2 23 House is directed to provide a copy of this resolution
  2 24 to the President of the United States, to the
  2 25 Secretary of the United States Department of Health
  2 26 and Human Services, to the President of the United
  2 27 States Senate, to the Speaker of the United States
  2 28 House of Representatives, to the Minority Leaders of
  2 29 the United States Senate and House of Representatives,
  2 30 and to each member of Iowa's congressional delegation.
