There is appropriated from the rebuild 1 8 Iowa infrastructure fund to the department for the 1 9 blind for the fiscal year beginning July 1, 2000, and 1 10 ending June 30, 2001, the following amount, or so much 1 11 thereof as is necessary, to be used for the purpose 1 12 designated: 1 13 For improvements to the facility for the blind: 1 14 .................................................. $ 122,000 1 15 DEPARTMENT OF CORRECTIONS 1 16 Sec. 2. There is appropriated from the rebuild 1 17 Iowa infrastructure fund to the department of 1 18 corrections for the fiscal year beginning July 1, 1 19 2000, and ending June 30, 2001, the following amounts, 1 20 or so much thereof as is necessary, to be used for the 1 21 purposes designated: 1 22 1. To supplement funds appropriated in 1998 Iowa 1 23 Acts, chapter 1219, section 2, subsection 3, for 1 24 construction of a 200-bed facility at the Iowa state 1 25 penitentiary at Fort Madison: 1 26 .................................................. $ 3,000,000 1 27 2. For community-based corrections projects in 1 28 Council Bluffs: 1 29 .................................................. $ 300,000 1 30 DEPARTMENT OF CULTURAL AFFAIRS 1 31 Sec. 3. There is appropriated from the rebuild 1 32 Iowa infrastructure fund to the department of cultural 1 33 affairs for the fiscal year beginning July 1, 2000, 1 34 and ending June 30, 2001, the following amount, or so 1 35 much thereof as is necessary, to be used for the 1 36 purpose designated: 1 37 For historical site preservation grants, to be used 1 38 for the restoration, preservation, and development of 1 39 historical sites: 1 40 .................................................. $ 2,500,000 1 41 Of the amount appropriated in this section, 1 42 $600,000 shall be allocated for the final year of a 1 43 multiyear funding effort by the state for the 1 44 preservation of a building with historical and 1 45 architectural significance, notwithstanding any 1 46 provision of this section to the contrary. 1 47 Historical site preservation grants shall only be 1 48 awarded for projects which meet the definition of 1 49 "vertical infrastructure" in section 8.57, subsection 1 50 5, paragraph "c". 2 1 In making grants pursuant to this section, the 2 2 department shall consider the existence and amount of 2 3 other funds available to an applicant for the 2 4 designated project. Each grant awarded from moneys 2 5 appropriated in this section shall not exceed $100,000 2 6 per project. Not more than two grants may be awarded 2 7 in each county. 2 8 DEPARTMENT OF ECONOMIC DEVELOPMENT 2 9 Sec. 4. There is appropriated from the rebuild 2 10 Iowa infrastructure fund to the department of economic 2 11 development for the fiscal year beginning July 1, 2 12 2000, and ending June 30, 2001, the following amounts, 2 13 or so much thereof as is necessary, to be used for the 2 14 purposes designated: 2 15 1. To be deposited in the physical infrastructure 2 16 assistance fund created in section 15E.175: 2 17 .................................................. $ 2,500,000 2 18 The department shall maximize the moneys 2 19 appropriated in this subsection, to the extent 2 20 possible, for physical infrastructure assistance 2 21 program projects which meet the definition of 2 22 "vertical infrastructure" in section 8.57, subsection 2 23 5, paragraph "c", or for projects which facilitate the 2 24 creation of "vertical infrastructure" projects. The 2 25 department shall report to the general assembly by 2 26 June 30 of each fiscal year for which funds are 2 27 appropriated in this subsection regarding the amount 2 28 of such funds used for "vertical infrastructure" 2 29 projects and the amount of such funds used for 2 30 projects which facilitate the creation of "vertical 2 31 infrastructure". 2 32 2. For accelerated career education program 2 33 capital projects at community colleges which are 2 34 authorized under chapter 260G and which meet the 2 35 definition of "vertical infrastructure" in section 2 36 8.57, subsection 5, paragraph "c": 2 37 ................................................ $ 5,300,000 2 38 The moneys appropriated in this subsection shall be 2 39 allocated equally among the community colleges in the 2 40 state. If any portion of the equal allocation to a 2 41 community college is not obligated or encumbered by 2 42 April 1, 2001, the unobligated and unencumbered 2 43 portions shall be available for use by other community 2 44 colleges. 2 45 3. For deposit in the rural enterprise fund to be 2 46 used for the dry fire hydrant and rural water supply 2 47 education and demonstration project, notwithstanding 2 48 section 8.57, subsection 5, paragraph "c": 2 49 .................................................. $ 200,000 2 50 DEPARTMENT OF GENERAL SERVICES 3 1 Sec. 5. There is appropriated from the rebuild 3 2 Iowa infrastructure fund to the department of general 3 3 services for the fiscal year beginning July 1, 2000, 3 4 and ending June 30, 2001, the following amount, or so 3 5 much thereof as is necessary, to be used for the 3 6 purpose designated: 3 7 1. For capital projects and improvements at 3 8 Terrace Hill: 3 9 .................................................. $ 1,200,000 3 10 For planning, design, and construction of a new 3 11 building to house department of public safety offices 3 12 and crime laboratory space and state medical examiner 3 13 laboratory, office, and related space: 3 14 .................................................. $ 3,200,000 3 15 Sec. 6. 1999 Iowa Acts, chapter 121, sections 11 3 16 and 12, are amended by striking the sections. 3 17 Sec. 7. 1999 Iowa Acts, chapter 204, section 4, 3 18 subsection 1, is amended to read as follows: 3 19 1. For major renovation and major repair needs 3 20 including health, life, and fire safety, for 3 21 compliance with the federal Americans With 3 22 Disabilities Act for state-owned buildings and 3 23 facilities: 3 24 FY 1999-2000 ..................................... $ 7,500,000 3 25 FY 2000-2001...................................... $7,500,0003 26 10,500,000 3 27 Notwithstanding section 8.57, subsection 5, 3 28 paragraph "c", of the amount appropriated foreachthe 3 29 fiscal year beginning July 1, 1999, in this 3 30 subsection, up to $800,000 may be used by the 3 31 department for routine maintenance needs for the 3 32 capitol complex. 3 33 The moneys appropriated in this subsection for the 3 34 fiscal year beginning July 1, 2000, shall be used for 3 35 the repair or replacement of building components to 3 36 return state-owned buildings or facilities to their 3 37 intended uses or to make them compliant with changes 3 38 in laws, regulations, or codes. The moneys shall be 3 39 allocated in accordance with the priorities and 3 40 recommendations set forth by the vertical 3 41 infrastructure advisory committee. The moneys 3 42 appropriated in this subsection for the fiscal year 3 43 beginning July 1, 2000, shall be allocated to the 3 44 following agencies in the following amounts, with the 3 45 balance to be retained by the department of general 3 46 services, to be used for purposes described in this 3 47 section: 3 48 a. Commission of veterans affairs: 4 14 .................................................. $ 189,000 4 15 Sec. 8. 1999 Iowa Acts, chapter 204, section 4, 4 16 subsection 15, is amended by striking the subsection. 4 17 Sec. 9. 1998 Iowa Acts, chapter 1219, section 6, 4 18 subsection 1, unnumbered paragraphs 3 and 4, as 4 19 amended and enacted by 1999 Iowa Acts, chapter 204, 4 20 section 39, are amended to read as follows: 4 21 Of the amount appropriated in this subsection, up 4 22 to $1,250,000 may be used by the department for the 4 23 purchase, demolition, assessment, and site 4 24 conditioning of property locatedat the southwest4 25corner of Lyon street and East Tenth street, together4 26with the contiguous property south of the southwest4 27corner property and the property between East Tenth4 28street and East Eleventh street between Lyon street4 29and Des Moines street, allwithin the following 4 30 boundaries: south of interstate 235, north of Grand 4 31 avenue, east of Pennsylvania avenue, and west of East 4 32 Fourteenth street in the city of Des Moines. 4 33 Of the amount appropriated in this subsection, up 4 34 to $430,000 may be used by the department to complete 4 35 the infrastructure assessment, notwithstanding section 4 36 8.57, subsection 5, paragraph "c". 4 37 JUDICIAL BRANCH 4 38 Sec. 10. There is appropriated from the rebuild 4 39 Iowa infrastructure fund to the judicial branch for 4 40 the fiscal year beginning July 1, 2001, and ending 4 41 June 30, 2002, the following amount, or so much 4 42 thereof as is necessary, to be used for the purpose 4 43 designated: 4 44 For construction of a new judicial building: 4 45 .................................................. $ 8,300,000 4 46 The judicial branch is authorized to enter into 4 47 contracts for the full cost of the planning, design, 4 48 and construction of a new judicial building for which 4 49 appropriations are made in this section and in 1998 4 50 Iowa Acts, chapter 1223, section 8, and 1999 Iowa 5 1 Acts, chapter 204, section 6. The state shall not be 5 2 obligated for costs associated with contracts 5 3 identified in this paragraph in excess of funds 5 4 appropriated by the general assembly. Notwithstanding 5 5 any provision of this Act to the contrary or section 5 6 8.33, moneys appropriated in this section that remain 5 7 unencumbered or unobligated at the close of the fiscal 5 8 year that begins July 1, 2003, shall revert at the 5 9 close of that fiscal year. However, if the project 5 10 for which the moneys are appropriated is completed in 5 11 an earlier fiscal year, unencumbered or unobligated 5 12 moneys shall revert at the close of that fiscal year. 5 13 Sec. 11. 1998 Iowa Acts, chapter 1219, section 8, 5 14 is amended to read as follows: 5 15 SEC. 8. The state shall not be 7 10 obligated for costs associated with contracts identified in 7 11 this paragraph in excess of the funds appropriated by the 7 12 general assembly. 7 13 STATE DEPARTMENT OF TRANSPORTATION 7 14 Sec. 15. There is appropriated from the rebuild 7 15 Iowa infrastructure fund to the state department of 7 16 transportation for the fiscal year beginning July 1, 7 17 2000, and ending June 30, 2001, the following amounts, 7 18 or so much thereof as is necessary, to be used for the 7 19 purposes designated: 7 20 1. For vertical infrastructure improvements at all 7 21 10 of the commercial air service airports within the 7 22 state: 7 23 .................................................. $ 1,000,000 7 24 One-half of the funds appropriated in this 7 25 subsection shall be allocated equally between each 7 26 commercial service airport, 40 percent of the funds 7 27 shall be allocated based on the percentage that the 7 28 number of enplaned passengers at each commercial 7 29 service airport bears to the total number of enplaned 7 30 passengers in the state during the previous fiscal 7 31 year, and 10 percent of the funds shall be allocated 7 32 based on the percentage that the air cargo tonnage at 7 33 each commercial service airport bears to the total air 7 34 cargo tonnage in the state during the previous fiscal 7 35 year. In order for a commercial service airport to 7 36 receive funding under this subsection, the airport 7 37 shall be required to submit applications for funding 7 38 of specific projects to the department for approval by 7 39 the state transportation commission. 7 40 2. For deposit in an aviation hangar revolving 7 41 loan fund, as created in this Act, for improvements to 7 42 and design and construction of hangars at general 7 43 aviation airports within the state: 7 44 .................................................. $ 500,000 7 45 OFFICE OF TREASURER OF STATE 7 46 Sec. 16. There is appropriated from the rebuild 7 47 Iowa infrastructure fund to the office of treasurer of 7 48 state for the fiscal year beginning July 1, 2000, and 7 49 ending June 30, 2001, the following amount, or so much 7 50 thereof as is necessary, to be used for the purpose 8 1 designated: 8 2 For county fair infrastructure improvements for 8 3 distribution in accordance with chapter 174 to 8 4 qualified fairs which belong to the association of 8 5 Iowa fairs: 8 6 .................................................. $ 1,060,000 8 7 Sec. 17. There is appropriated from the rebuild 8 8 Iowa infrastructure fund to the office of the 8 9 treasurer of state for the designated fiscal years, 8 10 the following amounts, or so much thereof as is 8 11 necessary, to be used for the purpose designated: 8 12 For deposit in the community attraction and tourism 8 13 fund: 8 14 FY 2001-2002...................................... $ 12,500,000 8 15 FY 2002-2003...................................... $ 12,500,000 8 16 FY 2003-2004...................................... $ 12,500,000 8 17 None of the moneys appropriated in this section 8 18 shall be used for the development of marketing efforts 8 19 or promotion of Iowa tourism attractions and events. 8 20 COMMISSION OF VETERANS AFFAIRS 8 21 Sec. 18. There is appropriated from the rebuild 8 22 Iowa infrastructure fund to the commission of veterans 8 23 affairs for the fiscal year beginning July 1, 2000, 8 24 and ending June 30, 2001, the following amounts, or so 8 25 much thereof as is necessary, to be used for the 8 26 purposes designated: 8 27 To supplement moneys appropriated in prior fiscal 8 28 years for construction of a new dining hall and food 8 29 services facility: 8 30 .................................................. $ 992,000 8 31 Sec. 19. REVERSION. Notwithstanding section 8.33, 8 32 moneys appropriated in this division of this Act that 8 33 remain unencumbered or unobligated at the close of the 8 34 fiscal year that begins July 1, 2003, shall revert at 8 35 the close of that fiscal year. However, if the 8 36 projects for which the moneys are appropriated are 8 37 completed in an earlier fiscal year, unencumbered or 8 38 unobligated moneys shall revert at the close of that 8 39 fiscal year. 8 40 Sec. 20. EFFECTIVE DATE. The following sections 8 41 of this division of this Act, being deemed of 8 42 immediate importance, take effect upon enactment: 8 43 1. Section 6, amending 1999 Iowa Acts, chapter 8 44 121, sections 11 and 12. 8 45 2. Sections 7 and 8, amending 1999 Iowa Acts, 8 46 chapter 204, section 4, subsections 1 and 15. 8 47 3. Section 9, amending 1998 Iowa Acts, chapter 8 48 1219, section 6, subsection 1, unnumbered paragraphs 3 8 49 and 4, as amended and enacted by 1999 Iowa Acts, 8 50 chapter 204, section 39. 9 1 4. Section 11, amending 1998 Iowa Acts, chapter 9 2 1219, section 8. 9 3 5. Section 12, amending 1998 Iowa Acts, chapter 9 4 1223, section 8. 9 5 DIVISION II 9 6 RESTORE THE OUTDOORS PROGRAM 9 7 AND ENVIRONMENT FIRST FUND 9 8 Sec. 21. NEW SECTION. 8.57A ENVIRONMENT FIRST 9 9 FUND. 9 10 1. An environment first fund is created under the 9 11 authority of the department of management. The fund 9 12 shall consist of appropriations made to the fund and 9 13 transfers of interest, earnings, and moneys from other 9 14 funds as provided by law. The fund shall be separate 9 15 from the general fund of the state and the balance in 9 16 the fund shall not be considered part of the balance 9 17 of the general fund of the state. However, the fund 9 18 shall be considered a special account for the purposes 9 19 of section 8.53, relating to generally accepted 9 20 accounting principles. 9 21 2. Moneys in the environment first fund are not 9 22 subject to section 8.33. Notwithstanding section 9 23 12C.7, subsection 2, interest or earnings on moneys in 9 24 the environment first fund shall be credited to the 9 25 rebuild Iowa infrastructure fund. 9 26 3. Moneys in the fund in a fiscal year shall be 9 27 used as appropriated by the general assembly for the 9 28 protection, conservation, enhancement, or improvement 9 29 of natural resources or the environment. 9 30 4. There is appropriated from the rebuild Iowa 9 31 infrastructure fund for the fiscal year beginning July 9 32 1, 2000, and for each fiscal year thereafter, the sum 9 33 of thirty-five million dollars to the environment 9 34 first fund, notwithstanding section 8.57, subsection 9 35 5, paragraph "c". 9 36 Sec. 22. Section 8.58, Code 1999, is amended to 9 37 read as follows: 9 38 8.58 EXEMPTION FROM AUTOMATIC APPLICATION. 9 39 To the extent that moneys appropriated under 9 40 section 8.57 do not result in moneys being credited to 9 41 the general fund under section 8.55, subsection 2, 9 42 moneys appropriated under section 8.57 and moneys 9 43 contained in the cash reserve fund, rebuild Iowa 9 44 infrastructure fund, environment first fund, and Iowa 9 45 economic emergency fund shall not be considered in the 9 46 application of any formula, index, or other statutory 9 47 triggering mechanism which would affect 9 48 appropriations, payments, or taxation rates, contrary 9 49 provisions of the Code notwithstanding. 9 50 To the extent that moneys appropriated under 10 1 section 8.57 do not result in moneys being credited to 10 2 the general fund under section 8.55, subsection 2, 10 3 moneys appropriated under section 8.57 and moneys 10 4 contained in the cash reserve fund, rebuild Iowa 10 5 infrastructure fund, environment first fund, and Iowa 10 6 economic emergency fund shall not be considered by an 10 7 arbitrator or in negotiations under chapter 20. 10 8 Sec. 23. Section 461A.3A, subsection 2, unnumbered 10 9 paragraph 1, Code 1999, is amended to read as follows: 10 10 There is appropriated from the rebuild Iowa 10 11 infrastructure fund for each fiscal year of the fiscal 10 12 period beginning July 1, 1997, and ending June 30, 10 1320012004, the sum of three million dollars to the 10 14 department for use in the restore the outdoors 10 15 program. Notwithstanding section 8.33, unencumbered 10 16 or unobligated moneys remaining at the end of a fiscal 10 17 year shall not revert but shall remain available for 10 18 expenditure during the following fiscal year for 10 19 purposes of the restore the outdoors program. 10 20 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 10 21 Sec. 24. There is appropriated from the 10 22 environment first fund to the department of 10 23 agriculture and land stewardship for the fiscal year 10 24 beginning July 1, 2000, and ending June 30, 2001, the 10 25 following amounts, or so much thereof as is necessary, 10 26 to be used for the purposes designated: 10 27 1. To implement a conservation reserve enhancement 10 28 program to restore and construct wetlands for the 10 29 purposes of intercepting tile line runoff, reducing 10 30 nutrient loss, improving water quality, and enhancing 10 31 agricultural production practices: 10 32 .................................................. $ 1,500,000 10 33 2. For implementation of a program that provides 10 34 multi-objective resource protections for flood 10 35 control, water quality, erosion control, and natural 10 36 resource conservation: 10 37 .................................................. $ 1,450,000 10 38 3. To initiate a statewide voluntary farm 10 39 management demonstration program to demonstrate the 10 40 effectiveness and adaptability of emerging practices 10 41 in agronomy that protect water resources and provide 10 42 other environmental benefits: 10 43 .................................................. $ 850,000 10 44 4. For assisting farm operators in applying for 10 45 project grants associated with the statewide voluntary 10 46 farm management demonstration program: 10 47 .................................................. $ 50,000 10 48 5. For deposit in the alternative drainage system 11 3 assistance fund created in section 159.29A to be used 11 4 for purposes of supporting the alternative drainage 11 5 system assistance program as provided in section 11 6 159.29B: 11 7 .................................................. $ 1,300,000 11 8 Of the amount appropriated in this section, 11 9 $300,000 shall be allocated to drainage district 176 11 10 to provide cost-share assistance for closing 11 11 agricultural drainage wells and constructing 11 12 alternative drainage systems in order to assist in 11 13 raising the level of cost-share payments to 75 percent 11 14 of the cost of the projects. 11 15 7. To provide financial assistance for the 11 16 establishment of permanent soil and water conservation 11 17 practices: 11 18 .................................................. $ 2,000,000 11 19 a. Not more than 5 percent of the moneys 11 20 appropriated in this subsection may be allocated for 11 21 cost-sharing to abate complaints filed under section 11 22 161A.47. 11 23 b. Of the moneys appropriated in this subsection, 11 24 5 percent shall be allocated for financial incentives 11 25 to establish practices to protect watersheds above 11 26 publicly owned lakes of the state from soil erosion 11 27 and sediment as provided in section 161A.73. 11 28 c. Not more than 30 percent of a district's 11 29 allocation of moneys as financial incentives may be 11 30 provided for the purpose of establishing management 11 31 practices to control soil erosion on land that is row- 11 32 cropped, including but not limited to no-till 11 33 planting, ridge-till planting, contouring, and contour 11 34 strip-cropping as provided in section 161A.73. 11 35 d. The state soil conservation committee created 11 36 in section 161A.4 may allocate moneys appropriated in 11 37 this subsection to conduct research and demonstration 11 38 projects to promote conservation tillage and nonpoint 11 39 source pollution control practices. 11 40 e. The financial incentive payments may be used in 11 41 combination with department of natural resources 11 42 moneys. 11 43 8. To encourage and assist farmers in enrolling in 11 44 the continuous sign-up federal conservation reserve 11 45 program and work with them to enhance their 11 46 revegetation efforts to improve water quality and 11 47 habitat: 11 48 .................................................. $ 1,500,000 11 49 DEPARTMENT OF ECONOMIC DEVELOPMENT 11 50 Sec. 25. There is appropriated from the 12 1 environment first fund to the department of economic 12 2 development for the fiscal year beginning July 1, 12 3 2000, and ending June 30, 2001, the following amount, 12 4 or so much thereof as is necessary, to be used for the 12 5 purpose designated: 12 6 For deposit in the brownfield redevelopment fund to 12 7 provide assistance under the brownfield redevelopment 12 8 program, if the fund is created by the Seventy-eighth 12 9 General Assembly, Second Session: 12 10 .................................................. $ 3,000,000 12 11 DEPARTMENT OF NATURAL RESOURCES 12 12 Sec. 26. There is appropriated from the 12 13 environment first fund to the department of natural 12 14 resources for the fiscal year beginning July 1, 2000, 12 15 and ending June 30, 2001, the following amounts, or so 12 16 much thereof as is necessary, to be used for the 12 17 purposes designated: 12 18 1. To establish a program to assist rural 12 19 homeowners in improving on-site wastewater systems: 12 20 .................................................. $ 600,000 12 21 2. To provide local watershed managers with 12 22 geographic information system data for their use in 12 23 developing, monitoring, and displaying results of 12 24 their watershed work: 12 25 .................................................. $ 195,000 12 26 3. For continuing the establishment and operation 12 27 of water quality monitoring stations: 12 28 .................................................. $ 1,950,000 12 29 4. To develop a program to support local volunteer 12 30 management efforts in water quality programs: 12 31 .................................................. $ 70,000 12 32 5. To establish and implement improved water 12 33 quality planning, standards, and assessment: 12 34 .................................................. $ 372,000 12 35 6. For contracting to assist department staff with 12 36 the review of national pollutant discharge elimination 12 37 system permits: 12 38 .................................................. $ 250,000 12 39 7. To expand the floodplain protection education 12 40 to better inform local officials that make decisions 12 41 with regard to floodplain management: 12 42 .................................................. $ 200,000 12 43 8. To identify an effective and efficient method 12 44 of developing a total maximum daily load program: 12 45 .................................................. $ 153,000 12 46 9. For the dredging of lakes, including necessary 12 47 preparation for dredging, in accordance with the 12 48 department's classification of Iowa lakes restoration 12 49 report: 12 50 .................................................. $ 2,900,000 13 1 a. Of the amount appropriated in this subsection, 13 2 up to $200,000 may be used by the department to 13 3 provide assistance to qualified applicants for 13 4 purposes of financing capital improvements to natural 13 5 or constructed lakes including but not limited to 13 6 dredging, installation or repair of erosion control 13 7 measures, and land acquisition. To qualify for 13 8 assistance, an applicant must be a nonprofit 13 9 organization based in the community where the lake is 13 10 located which is active in sponsoring improvements to 13 11 the lake and is capable of managing or overseeing the 13 12 improvements or be a governmental body. Assistance 13 13 shall not be provided to construct a new lake. 13 14 Notwithstanding any contrary provision of this 13 15 subsection, the department may consider grants for any 13 16 public lakes. 13 17 b. To qualify for assistance under paragraph "a", 13 18 an applicant must demonstrate that existing or planned 13 19 infrastructure and practices are capable of ensuring 13 20 long-term benefits to the lake. An applicant must 13 21 also show that each dollar of assistance will be 13 22 matched by one dollar contributed by a source other 13 23 than the state. 13 24 10. For a community-based grant distribution 13 25 program to provide funding for the planting of trees 13 26 throughout the state: 13 27 .................................................. $ 250,000 13 28 11. For a contribution towards the development of 13 29 the Lewis and Clark rural water system: 13 30 .................................................. $ 60,000 13 31 12. For continuation of the waste tire abatement 13 32 program: 13 33 .................................................. $ 500,000 13 34 Of the amount appropriated in this subsection, up 13 35 to $50,000 may be used by the department for 13 36 administration costs of the program. 13 37 13. For recreational grants to be used for the 13 38 restoration or construction of recreational complexes 13 39 or facilities under the recreational grant matching 13 40 program: 13 41 .................................................. $ 3,000,000 13 42 Matching grants awarded from the funds appropriated 13 43 in this subsection shall be awarded on a matching 13 44 basis of one dollar for every two dollars the 13 45 applicant had raised. 13 46 The department shall give special consideration to 13 47 recreational complex or facility projects which 13 48 involve public and private sector participation. 13 49 14. For purposes of funding capital projects for 13 50 the purposes specified in section 452A.79, and for 14 1 expenditures for the local cost share grants to be 14 2 used for capital expenditures to local governmental 14 3 units for boating accessibility: 14 4 .................................................. $ 2,300,000 14 5 Sec. 27. REVERSION. Notwithstanding section 8.33, 14 6 moneys appropriated in this division of this Act shall 14 7 not revert on the close of the fiscal year for which 14 8 they were appropriated, but shall remain available for 14 9 expenditure for subsequent fiscal years or until the 14 10 close of the fiscal year beginning July 1, 2003, or 14 11 until the project for which the appropriation was made 14 12 is completed, whichever is the earlier. 14 13 DIVISION III 14 14 RESOURCES ENHANCEMENT AND PROTECTION FUND 14 15 Sec. 28. Notwithstanding the amount of the 14 16 standing appropriation from the general fund of the 14 17 state under section 455A.18, subsection 3, there is 14 18 appropriated from the environment first fund to the 14 19 Iowa resources enhancement and protection fund, in 14 20 lieu of the appropriation made in section 455A.18, for 14 21 the fiscal year beginning July 1, 2000, and ending 14 22 June 30, 2001, the following amount, to be allocated 14 23 as provided in section 455A.19: 14 24 .................................................. $ 10,500,000 14 25 DIVISION IV 14 26 MISCELLANEOUS CODE LANGUAGE CHANGES 14 27 AND OTHER PROVISIONS 14 28 Sec. 29. Section 8.57, subsection 5, paragraph e, 14 29 Code 1999, is amended to read as follows: 14 30 e. Notwithstanding provisions to the contrary in 14 31 sections 99D.17 and 99F.11, for the fiscalyears14 32beginning July 1, 1995, andyear beginning July 1, 14 3319962000, and for each fiscal year thereafter, not 14 34 more than a total of sixty million dollars; and for14 35each fiscal year thereafter;shall be deposited in the 14 36 general fund of the state in any fiscal year pursuant 14 37 to sections 99D.17 and 99F.11. The next fifteen 14 38 million dollars of the moneys directed to be deposited 14 39 in the general fund of the state in a fiscal year 14 40 pursuant to sections 99D.17 and 99F.11 shall be 14 41 deposited in the vision Iowa fund created in section 14 42 12.72 for the fiscal year beginning July 1, 2000, and 14 43 for each fiscal year through the fiscal year beginning 14 44 July 1, 2019. The next five million dollars of the 14 45 moneys directed to be deposited in the general fund of 14 46 the state in a fiscal year pursuant to sections 99D.17 14 47 and 99F.11 shall be deposited in the school 14 48 infrastructure fund created in section 12.82 for the 14 49 fiscal year beginning July 1, 2000, and for each 14 50 fiscal year thereafter until the principal and 15 1 interest on all bonds issued by the treasurer of state 15 2 pursuant to section 12.81 are paid, as determined by 15 3 the treasurer of state. The total moneys in excess of 15 4 the moneys deposited in the general fund of the state, 15 5 the vision Iowa fund, and the school infrastructure 15 6 fund in a fiscal year shall be deposited in the 15 7 rebuild Iowa infrastructure fund and shall be used as 15 8 provided in this section, notwithstanding section 15 9 8.60. 15 10 Sec. 30. NEW SECTION. 12.72A VISION IOWA FUND 15 11 MONEYS ADMINISTRATIVE COSTS. 15 12 During the term of the vision Iowa program 15 13 established in section 15F.302, one hundred thousand 15 14 dollars of the moneys deposited each fiscal year in 15 15 the vision Iowa fund and appropriated for the vision 15 16 Iowa program shall be allocated each fiscal year to 15 17 the department of economic development for 15 18 administrative costs incurred by the department for 15 19 purposes of administering the vision Iowa program. 15 20 Sec. 31. NEW SECTION. 12.82A SCHOOL 15 21 INFRASTRUCTURE FUND MONEYS STATE FIRE MARSHAL. 15 22 During the term of the school infrastructure 15 23 program established in section 292.2, up to fifty 15 24 thousand dollars of the moneys deposited each fiscal 15 25 year in the school infrastructure fund shall be 15 26 allocated each fiscal year to the department of public 15 27 safety for the use of the state fire marshal. The 15 28 funds shall be used by the state fire marshal solely 15 29 for the purpose of retaining an architect or 15 30 architectural firm to evaluate structures for which 15 31 school infrastructure program grant applications are 15 32 made, to consult with school district representatives, 15 33 to review construction drawings and blueprints, and to 15 34 perform related duties at the direction of the state 15 35 fire marshal to ensure the best possible use of moneys 15 36 received by a school district under the school 15 37 infrastructure program. The state fire marshal shall 15 38 provide for the review of plans, drawings, and 15 39 blueprints in a timely manner. 15 40 Sec. 32. Section 18.3, subsection 7, Code 1999, is 15 41 amended by adding the following new unnumbered 15 42 paragraph: 15 43 NEW UNNUMBERED PARAGRAPH. If the department 15 44 intends to bill a state agency for a service provided 15 45 by the department under this subsection, the 15 46 department shall notify the state agency of the 15 47 department's intention and of the costs of providing 15 48 the service prior to providing the service. The state 15 49 agency may request that all or a part of the service 15 50 not be provided by the department if all or a part of 16 1 the service will be provided by a person employed by 16 2 the state agency or a person under contract with the 16 3 state. An action by the department or a state agency 16 4 related to the provision of, billing for, or request 16 5 to not perform a service under this subsection, is 16 6 subject to review by the executive council upon 16 7 complaint from any state agency adversely affected. 16 8 Sec. 33. NEW SECTION. 18A.6 CAPITOL COMPLEX 16 9 PROJECTS. 16 10 All capital projects on the capitol complex shall 16 11 be planned, approved, and funded only after 16 12 considering the guiding principles enunciated in any 16 13 capitol complex master plan adopted by the commission 16 14 on or after January 1, 2000. At a minimum, the extent 16 15 to which the proposed capital project does all of the 16 16 following shall be considered: 16 17 1. Preserves and enhances the dignity, beauty, and 16 18 architectural integrity of the capitol building, other 16 19 state office buildings, and the capitol grounds. 16 20 2. Protects and enhances the public open spaces on 16 21 the capitol complex when deemed necessary for public 16 22 use and enjoyment. 16 23 3. Protects the most scenic public views to and 16 24 from the capitol building. 16 25 4. Recognizes the diversity of adjacent 16 26 neighborhoods and reinforces the connection of the 16 27 capitol complex to its neighbors and the city of Des 16 28 Moines. 16 29 5. Accommodates pedestrian and motorized traffic 16 30 that achieves appropriate public accessibility. 16 31 This section applies only to projects for which a 16 32 construction site was not determined prior to the 16 33 effective date of this Act. 16 34 Sec. 34. NEW SECTION. 330.2 AVIATION HANGAR 16 35 REVOLVING LOAN FUND. 16 36 An aviation hangar revolving loan fund is 16 37 established in the office of the treasurer of state 16 38 under the control of the state department of 16 39 transportation. Moneys in the fund are appropriated 16 40 for the purposes set forth in this section. Moneys in 16 41 the fund shall be expended for loans to provide 16 42 assistance for the design, construction, or 16 43 improvement of hangars at general aviation airports in 16 44 the state. The department shall adopt rules to 16 45 administer a program for the granting and 16 46 administration of loans under this section. The 16 47 department may enter into agreements with general 16 48 aviation airports for carrying out the purposes of 16 49 this section. Moneys received as loan repayments shall 16 50 be credited to the aviation hangar revolving loan 17 1 fund. Notwithstanding section 8.33, moneys in the 17 2 aviation hangar revolving loan fund shall not revert 17 3 to any other fund but shall remain available 17 4 indefinitely for expenditure under this section. 17 5 Sec. 35. 1999 Iowa Acts, chapter 204, section 17, 17 6 is amended by adding the following new unnumbered 17 7 paragraph: 17 8 NEW UNNUMBERED PARAGRAPH. Notwithstanding section 17 9 8.33, moneys appropriated for noncapital expenditures 17 10 in this division of this Act shall not revert on the 17 11 close of the fiscal year for which they were 17 12 appropriated, but shall remain available for 17 13 expenditure for subsequent fiscal years or until the 17 14 close of the fiscal year beginning July 1, 2003, or 17 15 until the project for which the appropriation was made 17 16 is completed, whichever is the earlier. 17 17 Sec. 36. VISION IOWA PROGRAM FTE AUTHORIZATION. 17 18 The department of economic development is authorized 17 19 one additional FTE above those otherwise authorized in 17 20 2000 Iowa Acts, Senate File 2428, for purposes of 17 21 administrative duties associated with the vision Iowa 17 22 program created in section 15F.302. 17 23 Sec. 37. CONTINGENT EFFECTIVENESS. Sections 17, 17 24 29, 30, 31, and 36 of this Act take effect only if 17 25 2000 Iowa Acts, Senate File 2447, is enacted by the 17 26 General Assembly. 17 27 Sec. 38. EFFECTIVE DATE. This division of this 17 28 Act, being deemed of immediate importance, takes 17 29 effect upon enactment." 17 30 2.
