  1  1    Amend Senate File 2447, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 28, by inserting after line 29 the
  1  4 following:
  1  5    "9.  A school district shall not be eligible for
  1  6 financial assistance under the program if the school
  1  7 district is located in whole or in part in a county
  1  8 which has imposed a sales and services tax for school
  1  9 infrastructure pursuant to section 422E.2 and has a
  1 10 capacity per pupil above the statewide average for
  1 11 capacity per pupil."
