  1  1    Amend the amendment, H-8523, to House File 2530, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 1 the
  1  4 following:
  1  5    "#   .  Page 12, lines 5 and 6, by striking the
  1  6 words "refuse-derived fuel,".
  1  7    #   .  Page 12, line 10, by striking the words "one
  1  8 hundred" and inserting the following:  "twenty-five"."
  1  9    #2.  Page 1, line 5, by striking the word
  1 10 "Commencing" and inserting the following:  "(a)
  1 11 Commencing".
  1 12    #3.  Page 1, by striking lines 15 and 16 and
  1 13 inserting the following:  "increase to eight percent.
  1 14    (b)  For purposes of calculating an amount under
  1 15 subparagraph subdivision (a), the following apply:
  1 16    (i)  For purposes of the four percent requirement,
  1 17 no more than one-half of the renewable energy or
  1 18 renewable energy credits shall be attributable from
  1 19 existing facilities brought on line prior to January
  1 20 1, 2000.
  1 21    (ii)  For purposes of the six percent requirement,
  1 22 no more than one-third of the renewable energy or
  1 23 renewable energy credits shall be attributable from
  1 24 existing facilities brought on line prior to January
  1 25 1, 2000.
  1 26    (iii)  For purposes of the eight percent
  1 27 requirement, no more than one-quarter of the renewable
  1 28 energy or renewable energy credits shall be
  1 29 attributable from existing facilities brought on line
  1 30 prior to January 1, 2000."
  1 31    #4.  Page 1, by striking lines 24 and 25 and
  1 32 inserting the following:  "energy facility.  The
  1 33 output of the facility must be readily capable of
  1 34 being physically metered and verified in this state by
  1 35 the board."
  1 36    #5.  Page 1, by striking lines 42 through 44 and
  1 37 inserting the following:  "credits."
  1 38    #6.  Page 1, line 49, by striking the word
  1 39 "facility" and inserting the following:  "facility."
  1 40    #7.  By striking page 1, line 50, through page 2,
  1 41 line 2, and inserting the following:  "The output of
  1 42 the facility must be readily capable of being
  1 43 physically metered and verified in this state by the
  1 44 board.  Credits may be for more than one-".
  1 45    #8.  Page 2, by striking lines 3 through 5 and
  1 46 inserting the following:  "year duration."
  1 47    #9.  Page 2, by striking lines 8 through 13 and
  1 48 inserting the following:  "requirements of paragraph
  1 49 "a" that permits an end-use consumer with a qualifying
  1 50 small renewable energy facility to use net billing.

  2  2    #10.  Page 2, lines 16 and 17, by striking the
  2  3 words "only for the difference in an applicable
  2  4 billing period" and inserting the following:  "for the
  2  5 difference".
  2  6    #11.  Page 2, line 21, by inserting after the word
  2  7 "facility." the following:  "If electricity generated
  2  8 by the consumer-generator exceeds the electricity
  2  9 supplied by the competitive electric service provider,
  2 10 the consumer-generator shall not be billed for the
  2 11 energy but only for usual consumer charges for the
  2 12 applicable billing period and shall be credited for
  2 13 the excess kilowatt-hours generated during the
  2 14 applicable billing period, with the kilowatt-hour
  2 15 credit appearing on the consumer-generated electricity
  2 16 billing for the following applicable billing period.
  2 17 On September 30 of each calendar year, any accumulated
  2 18 unused kilowatt-hour credits shall be purchased at a
  2 19 rate per kilowatt-hour to be determined by the board.
  2 20 The rate per kilowatt-hour determined by the board
  2 21 shall not be more than the rate at which the consumer-
  2 22 generator would have been billed for a kilowatt-hour
  2 23 supplied to the consumer-generator during the most
  2 24 recent billing period."
  2 25    #12.  Page 2, by striking lines 24 through 27 and
  2 26 inserting the following:  "located on the property of
  2 27 the end-use consumer; serves the electricity energy
  2 28 needs of the end-use customer; and is operated in
  2 29 parallel with the".
  2 30    #13.  Page 2, line 31, by inserting after the word
  2 31 "availability" the following:  "plus one hundred
  2 32 percent of the kilowatt-hours purchased on September
  2 33 30 of each year".
  2 34    #14.  Page 2, by inserting after line 31 the
  2 35 following:
  2 36    "(2A)  Credits may be certified by the board if
  2 37 they are issued by another state government for
  2 38 kilowatt-hours produced by a qualifying renewable
  2 39 energy facility that would qualify for credits in this
  2 40 state if produced in this state, if such energy is
  2 41 able to be metered in this state, and if that energy
  2 42 is verified by the board as not being used to serve or
  2 43 otherwise claimed as applicable to renewable energy
  2 44 sales requirements outside this state."
  2 45    #15.  Page 3, by striking lines 17 through 28 and
  2 46 inserting the following:
  2 47    "d.  SHORTFALLS.  If the board finds that a service
  2 48 provider fails to acquire sufficient renewable
  2 49 generation, purchase renewable energy, or receive
  2 50 renewable credits as required under this subsection,
  3  1 the service provider shall be assessed a penalty of
  3  2 fifty dollars per megawatt hour that such provider has
  3  3 failed to generate purchase or receive credits for, or
  3  4 two hundred percent of the average costs of credits
  3  5 traded during the year, as determined by the board.
  3  6 Penalties collected shall be remitted to the
  3  7 environmental fund."
  3  8    #16.  Page 3, by striking lines 29 through 43 and
  3  9 inserting the following:
  3 10    "e.  WAIVERS.  (1)  The board may waive all or part
  3 11 of the renewable energy portfolio requirements if the
  3 12 board determines that extraordinary circumstances are
  3 13 present and compliance with such requirement would
  3 14 prevent or severely curtail the service provider's
  3 15 ability to participate in the market, or where a
  3 16 consumer-owned utility can demonstrate that a statute
  3 17 or a contract in effect as of January 1, 2000,
  3 18 precludes compliance."
  3 19    #17.  Page 5, line 8, by striking the words "and
  3 20 otherwise ensure".
  3 21    #18.  Page 5, lines 26 and 27, by striking the
  3 22 words "prior to the effective date of this Act" and
  3 23 inserting the following:  "on or after January 1,
  3 24 1990, but prior to January 1, 2000".
  3 25    #19.  By striking page 5, line 33, through page 6,
  3 26 line 24.
  3 27    #20.  Page 7, line 47, by striking the words "At
  3 28 least three" and inserting the following:  "Three".
  3 29    #21.  Page 10, line 27, by striking the word and
  3 30 figure "and 8" and inserting the following:  "through
  3 31 11".
  3 32    #22.  Page 10, by striking lines 30 through 35 and
  3 33 inserting the following:  "thousand dollars per year.
  3 34 Surcharge amounts collected shall be used by the
  3 35 department of natural resources for renewable energy
  3 36 or energy efficiency programs as deemed appropriate by
  3 37 the department, after consultation with the advisory
  3 38 committee established in subsection 5, paragraph "b".
  3 39 The monthly surcharge shall commence with bills issued
  3 40 on October 1, 2002.  The monthly surcharge for energy
  3 41 efficiency programs shall cease to be collected with
  3 42 bills issued after December 31, 2016.  The monthly
  3 43 surcharge for renewable energy programs shall cease to
  3 44 be collected with bills issued after December 31,
  3 45 2021."
  3 46    #23.  Page 12, by striking lines 19 and 20 and
  3 47 inserting the following:
  3 48    "(  )  One person representing the Iowa energy
  3 49 center at Iowa state university of science and
  3 50 technology, appointed by its president.
  4  1    (  )  One person representing the center for global
  4  2 and regional environmental research at the university
  4  3 of Iowa, appointed by its president.
  4  4    (  )  One person representing the center for energy
  4  5 and environmental education at the university of
  4  6 northern Iowa, appointed by its president.

  4  8 natural resources."

  4 11    "The department of natural resources shall convene
