  1  1    Amend House File 2565 as follows:
  1  2    #1.  Page 13, by inserting after line 18, the
  1  3 following:
  1  4    "Sec.   .  Section 453A.39, Code 1999, is amended
  1  5 by striking the section and inserting in lieu thereof
  1  6 the following:
  1  7    453A.39  TOBACCO PRODUCTS, CIGARETTES –
  1  8 PROHIBITIONS.
  1  9    In order to promote the tobacco use prevention and
  1 10 control partnership established in section 142A.1, the
  1 11 following persons shall comply with the following, as
  1 12 applicable:
  1 13    1.  A manufacturer, distributor, wholesaler,
  1 14 retailer, or distributing agent or agent thereof shall
  1 15 not give away cigarettes or tobacco products.
  1 16    2.  A manufacturer, distributor, wholesaler,
  1 17 retailer, or distributing agent or agent thereof shall
  1 18 not provide free articles, products, commodities,
  1 19 gifts, or concessions in any exchange for the purchase
  1 20 of cigarettes or tobacco products.
  1 21    3.  The prohibitions in this section do not apply
  1 22 to transactions between manufacturers, distributors,
  1 23 wholesalers, or retailers."
