1 41 "Sec. . Section 570.1, Code 1999, is amended to
1 42 read as follows:
1 43 570.1 LIEN CREATED PROPERTY SUBJECTED.
1 44 1. A landlord shall have a lien for the rent upon
1 45 all crops grown upon the leased premises, and upon any
1 46 other personal property of the tenant which has been
1 47 used or kept thereon during the term and which is not
1 48 exempt from execution.
1 49 2. In order to perfect a lien in farm products as
1 50 defined in section 554.9102, which is created under
2 1 this section, a landlord must file a financing
2 2 statement as required by section 554.9308, subsection
2 3 2. Except as provided in chapters 571, 572, 579A,
2 4 579B, and 581, a perfected lien in the farm products
2 5 has priority over a conflicting security interest or
2 6 lien, including a security interest or lien that was
2 7 perfected prior to the creation of the lien under this
2 8 section, if the lien created in this section is
2 9 perfected on either of the following dates:
2 10 a. Prior to July 1, 2001.
2 11 b. When the debtor takes possession of the leased
2 12 premises or within twenty days after the debtor takes
2 13 possession of the leased premises.
2 14 A financing statement filed to perfect a lien in
2 15 the farm products must include a statement that it is
2 16 filed for the purpose of perfecting a landlord's lien.
2 17 Within twenty days after a landlord who has filed a
2 18 financing statement receives a written demand,
2 19 authenticated as provided in Article 9 of chapter 554,
2 20 from a tenant, the landlord shall file a termination
2 21 statement, if the lien in the farm products has
2 22 expired or if the tenant is no longer in possession of
2 23 the leased premises and has performed all obligations
2 24 under the lease."
2 25 #9. By renumbering, relettering, or redesignating
2 26 and correcting internal references as necessary.
