  1  1    Amend Senate File 2430, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 16, by inserting after line 32, the
  1  4 following:
  1  5    "Sec. __.  PILOT PROJECT FOR REFUND OF APPLICATION
  1  6 FEES BY THE DEPARTMENT OF NATURAL RESOURCES.
  1  7    1.  The department of natural resources may
  1  8 establish a pilot project for the refund of all or a
  1  9 portion of fees required to be paid to the department
  1 10 for issuing a stormwater discharge permit pursuant to
  1 11 section 455B.103A, if the department fails to issue
  1 12 the permit in a manner and within a period of time
  1 13 customary for issuing such permits.  However, the
  1 14 department is not required to refund any amount of a
  1 15 fee if the failure to issue the permit is primarily
  1 16 caused by the applicant, including the applicant's
  1 17 failure to comply with legal requirements, furnish a
  1 18 completed application or document, or cooperate with
  1 19 the department as required of applicants by the
  1 20 department.
  1 21    2.  The department of natural resources shall adopt
  1 22 rules as necessary in order to establish and
  1 23 administer this section.
  1 24    3.  The department may consider a decision not to
  1 25 issue a refund under this section as a final agency
  1 26 action which is not subject to a contested case
  1 27 proceeding or further agency review under chapter
  1 28 17A."
