Page 27, by inserting after line 32 the 1 39 following: 1 40 "Sec. . NEW SECTION. 256.39A EMPLOYABILITY 1 41 SKILLS ASSESSMENT REIMBURSEMENTS. 1 42 1. If the general assembly appropriates moneys to 1 43 pay school district claims for the costs of 1 44 employability skills assessment tools, the department 1 45 of education shall reimburse school district claims 1 46 for the costs of acquiring, administering, and scoring 1 47 assessment tools to assess the employability skills of 1 48 students. The director of education shall identify 1 49 available employability skills assessment tools that 1 50 school districts may use to meet the claim 2 1 reimbursement requirements of this section. 2 2 2. In order to be eligible for reimbursement under 2 3 this section, a school district shall submit a claim 2 4 on forms provided by the department by July 15, and 2 5 the claim shall state the actual costs incurred and 2 6 shall be accompanied by an affidavit of an officer of 2 7 the school district affirming the accuracy of the 2 8 claim. 2 9 3. A school district that submits to the 2 10 department a claim for reimbursement in accordance 2 11 with this section shall develop and integrate specific 2 12 employability skills, goals, and activities into the 2 13 comprehensive school improvement plan required under 2 14 section 256.7, subsection 21, paragraph "a". 2 15 4. The department of education shall certify to 2 16 the department of revenue and finance the total 2 17 amounts of approved claims to be paid and, to the 2 18 extent moneys are appropriated, the department of 2 19 revenue and finance shall draw warrants payable to 2 20 school districts with approved claims, taking into 2 21 consideration the relative budget and cash position of 2 22 the state resources. If the funds appropriated for 2 23 purposes of this section are insufficient to pay in 2 24 full the claims submitted by school districts and 2 25 approved by the department, the amounts of approved 2 26 claims shall be prorated among all school districts 2 27 with approved claims. 2 28 5. Moneys received under this section shall not be 2 29 commingled with state aid payments made under section 2 30 257.16 to a school district and shall be accounted for 2 31 by the school district separately from state aid 2 32 payments. Payments made to a school district under 2 33 this section are miscellaneous income for purposes of 2 34 chapter 257." 2 35 #4. Page 37, by inserting after line 18 the 2 36 following: 2 37 "Sec. . NEW SECTION. 261.22 CAREER 2 38 OPPORTUNITIES AND RESOURCES FOR EDUCATION GRANTS. 2 39 1. A career opportunities and resources for 2 40 education grant program is established to be 2 41 administered by the college student aid commission. 2 42 An individual is eligible for the grant program if the 2 43 individual is a resident of this state who is enrolled 2 44 at a community college in a vocational program 2 45 designated as a career opportunities and resources for 2 46 education program in accordance with the provisions of 2 47 this section. The college student aid commission 2 48 shall adopt rules pursuant to chapter 17A to 2 49 administer this section. 2 50 2. The department of economic development shall 3 1 identify, at least every four years, targeted 3 2 industries that pay high wages and offer excellent 3 3 benefits and that correspond to Iowa's areas of 3 4 competitive advantage. The director of the department 3 5 of economic development shall submit this list of 3 6 targeted industries to the director of the department 3 7 of education. 3 8 3. The Iowa workforce development board shall 3 9 identify, at least every two years, targeted 3 10 occupations associated with the targeted industries 3 11 identified by the department of economic development 3 12 pursuant to subsection 2. In determining current and 3 13 predicting future targeted occupations, the director 3 14 of the department of workforce development shall seek 3 15 the cooperation and expertise of, among others, the 3 16 department of economic development, the college 3 17 student aid commission, the Iowa state occupational 3 18 information coordinating committee, the department of 3 19 education, business and technology advisory councils, 3 20 educators, labor organizations, chambers of commerce, 3 21 economic development professionals, trade 3 22 associations, and researchers. The director of the 3 23 department of workforce development shall submit the 3 24 approved list of targeted occupations to the director 3 25 of the department of education. 3 26 4. A community college may submit to the 3 27 department of education a proposal for designation as 3 28 a career opportunities and resources for education 3 29 program. A proposed program may be a new or existing 3 30 community college program and shall meet all of the 3 31 following criteria: 3 32 a. The program educates students to meet or exceed 3 33 the prerequisites for employment in a targeted 3 34 industry or targeted occupation identified in 3 35 accordance with this section. 3 36 b. A business guarantees to provide matching cash 3 37 or in-kind contributions to the community college for 3 38 the costs of the program. The matching funds or in- 3 39 kind contributions shall be equivalent to, at a 3 40 minimum, twenty percent of the program costs. 3 41 Matching funds shall not include tuition assistance 3 42 provided to a student who is employed by the business. 3 43 c. The program has an agreement with a business 3 44 whereby the business pledges to provide intellectual 3 45 assistance during the program's development and 3 46 implementation; internships, externships, and 3 47 scholarships to students in the program; and hiring 3 48 preferences to persons who successfully complete the 3 49 program. 3 50 5. The department of education and the department 4 1 of economic development shall develop a review and 4 2 approval process for the designation of community 4 3 college programs as career opportunities and resources 4 4 for education programs. 4 5 6. To be eligible to receive a grant under this 4 6 section, an applicant shall, in accordance with the 4 7 rules of the commission, do the following: 4 8 a. Complete and file an application for a career 4 9 opportunities and resources for education grant. The 4 10 individual shall be responsible for the prompt 4 11 submission of any information required by the 4 12 commission. 4 13 b. File a new application and submit information 4 14 as required by the commission annually on the basis of 4 15 which the applicant's eligibility for the renewed 4 16 grant will be evaluated and determined. 4 17 7. If a student receives financial aid from any 4 18 source other than the program established under this 4 19 section, the full amount of such financial aid shall 4 20 be considered part of the student's financial 4 21 resources available in determining the amount of the 4 22 student's financial need for the period of the 4 23 financial aid. Grant moneys received by a student in 4 24 accordance with this section shall be used to pay the 4 25 student's cost of attendance, which includes community 4 26 college tuition and fees, materials, textbooks and 4 27 supplies, transportation, room and board, dependent 4 28 care during the time the person is in class, and the 4 29 purchase or rental of a computer. 4 30 8. The amount of the grant shall not exceed a 4 31 student's annual financial need or two thousand five 4 32 hundred dollars, whichever is less. 4 33 9. In order to be excused from repayment of the 4 34 total grant amount, a grant recipient shall remain a 4 35 resident of the state and be employed within the 4 36 state, for a period of two years after successful 4 37 completion of a career opportunities and resources for 4 38 education program. If a grant recipient changes 4 39 residence to another state prior to the time specified 4 40 by the commission, the commission shall establish a 4 41 plan for repayment of the total grant amount, 4 42 including an amount of interest to be prescribed by 4 43 the commission by rule, over a ten-year period. If a 4 44 person required to make the repayment does not make 4 45 the required payments, the commission shall provide 4 46 for payment collection. 4 47 10. The departments of economic development, 4 48 education, and workforce development, the college 4 49 student aid commission, and the community colleges 4 50 with designated programs shall jointly promote the 5 1 career opportunities and resources for education 5 2 program to all appropriate populations. 5 3 11. A career opportunities and resources for 5 4 education repayment fund is created for deposit of 5 5 payments made by grant recipients who do not fulfill 5 6 the conditions of the commission's specified residency 5 7 and employment requirements, and for any other moneys 5 8 appropriated to or received by the commission for 5 9 deposit in the fund. Notwithstanding section 8.33, 5 10 moneys deposited in the fund shall not revert to the 5 11 general fund of the state at the end of any fiscal 5 12 year, except as provided in this paragraph, but shall 5 13 remain in the repayment fund and be continuously 5 14 available to make additional grants under the program. 5 15 Notwithstanding section 12C.7, subsection 2, interest 5 16 or earnings on moneys deposited in the fund shall be 5 17 credited to the fund. Upon the repeal of this 5 18 section, moneys deposited in the fund and moneys due 5 19 the fund subsequent to the date of repeal shall be 5 20 deposited in the general fund of the state. 5 21 12. The commission shall adopt rules pursuant to 5 22 chapter 17A to administer this section. 5 23 13. This section is repealed on July 1, 2005." 5 24 #5.
