  1  1    Amend House File 2530 as follows:
  1  2    #1.  Page 118, by striking lines 26 through 29 and
  1  3 inserting the following:
  1  4    "5.  A competitive electric service provider,
  1  5 delivery service provider, or generation company shall
  1  6 not interfere with, restrain, or coerce any employee
  1  7 or other person in the exercise of the right to
  1  8 disclose information to the board or other
  1  9 governmental body regarding the safety and reliability
  1 10 of the electrical system, or a portion of such system,
  1 11 provided that the employee reasonably believes that
  1 12 such information is true.  A competitive electric
  1 13 service provider, delivery service provider, or
  1 14 generation company shall not dismiss, demote,
  1 15 transfer, reprimand, harass, reduce the pay of,
  1 16 discriminate against, or otherwise retaliate against,
  1 17 any employee or other person because the employee or
  1 18 other person made such disclosure.  An employee or
  1 19 other person may bring an action in a court of proper
  1 20 jurisdiction and request a jury trial.  Upon a finding
  1 21 by a preponderance of the evidence that a competitive
  1 22 electric service provider, delivery service provider,
  1 23 or generation company has violated this subsection,
  1 24 the aggrieved party is entitled to reinstatement if
  1 25 the retaliatory action resulted in loss of employment,
  1 26 as well as an award for all damages incurred, court
  1 27 costs, and reasonable attorney fees.  Punitive damages
  1 28 in an amount not to exceed two hundred fifty thousand
  1 29 dollars may also be awarded, as appropriate."
