  1  1    Amend Senate File 2411 as amended, passed, and
  1  2 reprinted by the Senate as follows:
  1  3    #1.  Page 19, by inserting after line 7 the
  1  4 following:
  1  5    "Sec. 101.  Section 97B.45, subsection 4, Code
  1  6 1999, is amended to read as follows:
  1  7    4.  The first of any month in which the member is
  1  8 at least fifty-five years of age and for which the sum
  1  9 of the number of years of membership service and prior
  1 10 service and the member's age in years as of the
  1 11 member's last birthday equals or exceeds eighty-eight
  1 12 eighty-five."
  1 13    #2.  Page 25, by inserting after line 30 the
  1 14 following:
  1 15    "Sec. 102.  Section 97B.49G, subsection 4, Code
  1 16 1999, is amended by adding the following new
  1 17 paragraph:
  1 18    NEW PARAGRAPH.  e.  The member is an active or
  1 19 inactive vested member retiring on or after July 1,
  1 20 1997, and before the implementation date of section
  1 21 101 of this Act, as determined pursuant to section 103
  1 22 of this Act, who is at least fifty-five years of age
  1 23 and for which the sum of the number of years of
  1 24 membership service and prior service and the member's
  1 25 age in years as of the member's last birthday equals
  1 26 or exceeds eighty-eight."
  1 27    #3.  Page 55, by inserting after line 21 the
  1 28 following:
  1 29    "Sec. 103.  IMPLEMENTATION PROVISION.  The
  1 30 department of personnel shall implement the amendment
  1 31 to section 97B.45, subsection 4, as provided in this
  1 32 Act on July 1, 2000, or on the date that the
  1 33 department determines that the most recent annual
  1 34 actuarial valuation of the system indicates that the
  1 35 employer and employee contribution rates in effect
  1 36 under section 97B.11 can absorb the costs of the
  1 37 amendment to section 97B.45, subsection 4, whichever
  1 38 is later after meeting the other established
  1 39 priorities of the system.  As used in this section,
  1 40 "other established priorities of the system" means the
  1 41 implementation of the amendment to section 97B.52,
  1 42 subsection 1, as provided in section 52 of this Act.
  1 43 However, notwithstanding section 97B.49H, until the
  1 44 amendment to section 97B.49G, subsection 4, is
  1 45 implemented, the department shall not credit amounts
  1 46 to active member supplemental accounts provided in
  1 47 section 97B.49H."
  1 48    #4.  Page 55, line 33, by inserting after the word
  1 49 "Act" the following:  "and the implementation of the
  1 50 amendment to section 97B.45, subsection 4, as provided
  2  1 in section 101 of this Act".
