1 6 #3. Page 5, by inserting after line 32, the
1 7 following:
1 8 "Sec. . Section 6B.3, subsection 2, Code
1 9 Supplement 1999, is amended by striking the subsection
1 10 and inserting in lieu thereof the following:
1 11 2. The applicant shall mail a copy of the
1 12 application by certified mail to the owner at the
1 13 owner's last known address and to any record
1 14 lienholder or encumbrancer of the property at the
1 15 lienholder's or encumbrancer's last known address.
1 16 The applicant shall also cause the application to be
1 17 published once in a newspaper of general circulation
1 18 in the county, not less than four nor more than twenty
1 19 days before the meeting of the compensation commission
1 20 to assess the damages. Service of the application by
1 21 publication shall be deemed complete on the day of
1 22 publication.
1 23 In lieu of mailing and publishing the application,
1 24 the applicant may cause the application to be served
1 25 upon the owner, lienholders, and encumbrancers of the
1 26 property in the manner provided by the Iowa rules of
1 27 civil procedure for the personal service of original
1 28 notice. The application shall be mailed and published
1 29 or served, as above provided, prior to or
1 30 contemporaneously with the mailing and publication or
1 31 service of the list of compensation commissioners as
1 32 provided in section 6B.4."
1 33 #4. Page 10, line 20, by striking the word "open".
1 34 #5. Page 10, line 25, by striking the word "may"
1 35 and inserting the following: "shall".
