1 2 #1. Page 1, by inserting after line 34 the
1 3 following:
1 4 "Sec. . NEW SECTION. 12.36A DEPARTMENT OF
1 5 ECONOMIC DEVELOPMENT – OVERSIGHT.
1 6 The department of economic development shall
1 7 oversee programs administered by the treasurer of
1 8 state under this division. The treasurer of state
1 9 shall cooperate with the department in administering
1 10 the programs. The treasurer of state shall adopt
1 11 rules, including establishing requirements for
1 12 borrowers to participate in a program, and accept or
1 13 reject a linked investment loan package only after
1 14 review, comment, and approval by the department
1 15 according to procedures required by the department."
1 16 #2. Page 1, by inserting after line 34 the
1 17 following:
1 18 "Sec. . 12.36B SUSPENSION OF HORTICULTURAL AND
1 19 NONTRADITIONAL CROPS LINKED INVESTMENT LOAN PROGRAM.
1 20 1. The treasurer of state shall not do any of the
1 21 following:
1 22 a. Accept a linked investment loan package or any
1 23 portion of the package to support the horticultural
1 24 and nontraditional crops linked investment loan
1 25 program as provided in section 12.41 submitted after
1 26 the effective date of this Act.
1 27 b. Invest moneys in certificates of deposit in
1 28 eligible lending institutions to support the
1 29 horticultural and nontraditional crops linked
1 30 investment loan program as provided in section 12.41.
1 31 c. Renew certificates of deposit in eligible
1 32 lending institutions to support the horticultural and
1 33 nontraditional crops linked investment loan program as
1 34 provided in section 12.41, unless necessary in order
1 35 to honor an agreement with an eligible lending
1 36 institution as provided in section 12.35.
1 37 2. The treasurer of state shall administer
1 38 investment agreements with eligible lending
1 39 institutions pursuant to section 12.34 that are
1 40 executed before the effective date of this Act."
1 41 #3. By striking page 3, line 26, through page 4,
1 42 line 4, and inserting the following:
1 43 "1. Subject to the provisions of this section, all
1 44 of the following shall apply:
1 45 a. Sections 12.31 through 12.41 and 12.43 are
1 46 repealed.
1 47 b. Sections 12.36A, 12.36B, and 12.43A, as enacted
1 48 by this Act, are repealed."
1 49 #4. Page 4, line 7, by striking the words
1 50 "sections 12.34 and 12.43A" and inserting the
2 1 following: "this division".
2 2 #5. Page 4, by inserting after line 12 the
2 3 following:
2 4 "Sec. . REVIEW OF LINKED INVESTMENT FOR
2 5 TOMORROW ACT PROGRAMS. The general assembly shall
2 6 conduct a review of economic conditions requiring
2 7 programs under the linked investment for tomorrow Act
2 8 and the need for the continuation of programs under
2 9 the Act."
2 10 #6. Title page, by striking line 1 and inserting
2 11 the following: "An Act providing for linked
2 12 investment loan programs".
2 13 #7. Title page, line 2, by striking the words
2 14 "investment loan program,".
2 15 #8. By renumbering as necessary.
