  1  1    Amend House File 772 as follows:
  1  2    #1.  Page 15, by inserting after line 26 the
  1  3 following:
  1  4    "a.  It is the intent of the general assembly to
  1  5 protect water quality by increasing the use and
  1  6 production of ethanol and thereby furthering goals
  1  7 relating to protecting this state's environment.  The
  1  8 oxygenate enhancer methyl tertiary butyl ether
  1  9 (commonly referred to as "MTBE") is not a renewable
  1 10 fuel and poses a significant threat to this state's
  1 11 groundwater and surface water.
  1 12    b.  It is the policy of this state to encourage the
  1 13 production and use of motor vehicle fuel containing
  1 14 ethanol and to prohibit the production and use of
  1 15 methyl tertiary butyl ether.
  1 16    (1)  Prior to January 1, 2000, a retail dealer
  1 17 shall not offer for sale in this state a motor vehicle
  1 18 fuel that contains more than one percent of methyl
  1 19 tertiary butyl ether.
  1 20    (2)  On or after January 1, 2000, a retail dealer
  1 21 shall not offer for sale in this state a motor vehicle
  1 22 fuel that contains more than trace amounts of methyl
  1 23 tertiary butyl ether as provided by rules adopted by
  1 24 the department.  The department shall adopt rules
  1 25 necessary in order to ensure that methyl tertiary
  1 26 butyl ether does not cause a threat to the public
  1 27 health or environment by contaminating groundwater or
  1 28 surface water in this state.
  1 29    c.  The legislative council is requested to
  1 30 establish an interim committee to study issues
  1 31 relating to the sale, use, and health and
  1 32 environmental effects of oxygenate enhancers contained
  1 33 in motor vehicle fuel, including but not limited to
  1 34 ethanol and methyl tertiary butyl ether.  The interim
  1 35 committee shall report the findings and
  1 36 recommendations of its study, including any proposed
  1 37 legislation, to the general assembly as required by
  1 38 the legislative council prior to the 2000 Session of
  1 39 the Seventy-eighth General Assembly.
  1 40    d.  At sites where groundwater or soil monitoring
  1 41 is required, pursuant to section 455B.474, subsection
  1 42 1, paragraph "d", "f", or "h", the department of
  1 43 natural resources shall require that monitoring
  1 44 include testing for the presence of methyl tertiary
  1 45 butyl ether from the locations where other sample
  1 46 analyses are required.  The department shall provide
  1 47 regular updates to the interim committee established
  1 48 in subsection 1 as required by the interim committee.
  1 49 The department shall report the findings and
  1 50 recommendations of the testing to the general assembly
  2  1 prior to the 2000 Session of the Seventy-eighth
  2  2 General Assembly."
