  1  1    Amend House File 772 as follows:
  1  2    #1.  Page 8, by striking lines 12 and 13 and
  1  3 inserting the following:  "necessary, to be used for
  1  4 the purposes designated:"
  1  5    #2.  Page 8, line 27, by striking the word
  1  6 "department." and inserting the following:
  1  7 "department, notwithstanding section 8.57, subsection
  1  8 5, paragraph "c"."
  1  9    #3.  Page 22, by inserting after line 9 the
  1 10 following:
  1 11    "Sec. ___.  NEW SECTION.  73A.25  CONSTRUCTION
  1 12 MANAGEMENT CONTRACTS.
  1 13    1.  A municipality of this state shall publish
  1 14 notice of intent to award a contract for construction
  1 15 management services in relation to a public
  1 16 improvement.  The notice shall be published at least
  1 17 thirty, but not more than sixty, days prior to the
  1 18 award of the contract, in the manner provided in
  1 19 section 618.14.  The notice shall state the general
  1 20 nature of the public improvement for which
  1 21 construction management services are to be rendered,
  1 22 the type of construction management services to be
  1 23 rendered, and the time within which such services are
  1 24 to be rendered.
  1 25    2.  A contract for construction management services
  1 26 is not required to be let by sealed bids, provided
  1 27 there is no guarantee of the cost of construction by
  1 28 the person or entity providing the construction
  1 29 management services.
  1 30    3.  For purposes of this section, "construction
  1 31 management services" mean any services related in
  1 32 whole or in part to the planning, design, scheduling,
  1 33 or administration of the construction of a public
  1 34 improvement, except those services required to be
  1 35 performed by a licensed architect or engineer."
