1 21 "Sec. ___. NEW SECTION. 905A.1 LOCAL CORRECTIONS
1 22 INFRASTRUCTURE REVOLVING FUND.
1 23 1. A local corrections infrastructure revolving
1 24 fund is created in the office of the treasurer of
1 25 state to provide loans or loan guarantees to eligible
1 26 recipients for the purposes provided in this section.
1 27 The fund is under the authority of the division of
1 28 criminal and juvenile justice planning of the
1 29 department of human rights. The division shall adopt
1 30 rules pursuant to chapter 17A as necessary to
1 31 administer the revolving fund and to establish
1 32 criteria for providing loans or loan guarantees from
1 33 the fund. In establishing criteria, the division
1 34 shall give preference to cities or counties willing to
1 35 provide a local match for moneys provided from the
1 36 revolving fund. Notwithstanding section 8.33, moneys
1 37 in the fund at the end of a fiscal year shall not
1 38 revert to any other fund or to the general fund of the
1 39 state but shall remain in the revolving fund. The
1 40 fund shall consist of all appropriations, grants, or
1 41 gifts received by the division specifically for use as
1 42 provided by this section and all repayments of loans
1 43 made under this section.
1 44 2. A loan or loan guarantee authorized by this
1 45 section shall be utilized for any or all of the
1 46 following projects which meet the definition of
1 47 "vertical infrastructure" in section 8.57, subsection
1 48 5, paragraph "c":
1 49 a. A county jail.
1 50 b. A regional or multicounty jail.
2 1 3. For purposes of this section, "eligible
2 2 recipients" means a city or county which expends funds
2 3 for incarceration or supervision of individuals
2 4 charged with or convicted of a felony, an aggravated
2 5 misdemeanor, or a serious misdemeanor, or one or more
2 6 cities or counties as described in this subsection
2 7 within a judicial election district as described in
2 8 section 602.6109."
