  1  1    Amend the amendment, H-1636, to House File 767, as
  1  2 follows:
  1  3    #1.  Page 2, by inserting after line 5 the
  1  4 following:
  1  5    "Sec.    .  Section 12.40, subsection 1, Code 1999,
  1  6 is amended to read as follows:
  1  7    1.  As used in this section, "rural small business"
  1  8 means an existing a rural small business, for which
  1  9 local competition does not exist in the principal
  1 10 realm of business activity of that business, and the
  1 11 loss of which will work a hardship on the rural
  1 12 community.  A rural small business may include a
  1 13 grocery store, drug store, gasoline station,
  1 14 convenience store, hardware business, or farm supply
  1 15 store.  A rural small business does not include a new
  1 16 business.
  1 17    Sec.    .  Section 12.40, subsection 5, Code 1999,
  1 18 is amended by striking the subsection."
