  1  1    Amend House File 767 as follows:
  1  2    #1.  Page 18, by inserting after line 32 the
  1  3 following:
  1  4    "Sec. 101.  Section 514I.8, subsection 2, paragraph
  1  5 c, Code 1999, is amended to read as follows:
  1  6    c.  Is a member of a family whose adjusted gross
  1  7 income does not exceed one two hundred eighty-five
  1  8 percent of the federal poverty level, as defined in 42
  1  9 U.S.C. } 9902(2), including any revision required by
  1 10 such section.
  1 11    Sec. 102.  Section 514I.10, subsection 2, Code
  1 12 1999, is amended to read as follows:
  1 13    2.  Cost sharing for eligible children whose family
  1 14 adjusted gross income is between one hundred fifty
  1 15 percent and one two hundred eighty-five percent of the
  1 16 federal poverty level shall include a premium or
  1 17 copayment amount which is at least a minimum amount
  1 18 but which does not exceed five percent of the annual
  1 19 family adjusted gross income.  The amount of the
  1 20 premium or the copayment amount shall be based on a
  1 21 sliding fee scale established by rule which is based
  1 22 on family adjusted gross income and the size of the
  1 23 family.
  1 24    Sec. 103.  The certified capital company tax credit
  1 25 provided in section 15E.232 shall not be claimed until
  1 26 moneys have been made available for purposes of
  1 27 funding the changes made to the HAWK-I program made in
  1 28 sections 101 and 102."
