PAG LIN 1 1 Amend Senate File 449, as amended, passed, and 1 2 reprinted by the Senate, as follows: 1 3 #1. By striking everything after the enacting 1 4 clause and inserting the following: 1 5 "Section 1. Section 84A.5, subsection 6, Code 1 6 1999, is amended by adding the following new 1 7 paragraph: 1 8 NEW PARAGRAPH. f. The centers for new Iowans 1 9 established under section 84A.10. 1 10 Sec. 2. NEW SECTION. 84A.10 CENTERS FOR NEW 1 11 IOWANS. 1 12 1. For the purposes of this section, unless the 1 13 context otherwise requires, "foreign national" means a 1 14 person who is not a citizen of the United States, 1 15 including but not limited to a refugee, asylum seeker, 1 16 lawful permanent resident, and holder of a temporary 1 17 visa. 1 18 2. a. The department shall establish centers for 1 19 new Iowans to provide immigration counseling, 1 20 technical assistance, and referral services to persons 1 21 who are legal immigrants or foreign nationals who want 1 22 to work and reside or temporarily stay in this state. 1 23 A center shall be located so as to work in association 1 24 with each workforce development center established 1 25 under chapter 84B. The location of a center for new 1 26 Iowans and the provider of that center's services 1 27 shall be determined by the regional advisory board for 1 28 the service delivery area in which the associated 1 29 workforce development center is located. 1 30 b. A center may collaborate with the bureau of 1 31 refugee services in the department of human services, 1 32 with corporations, or with any other person in 1 33 providing assistance to refugees, but shall not 1 34 duplicate services to refugees. The department may 1 35 contract with a nonprofit agency for the 1 36 administration and operation of a center. 1 37 c. The department shall allocate funding among the 1 38 service delivery areas defined in section 84B.2 in 1 39 proportion to the number of legal immigrants and 1 40 foreign nationals in each service delivery area who 1 41 have not resided in Iowa for more than five years as 1 42 compared to the total number of legal immigrants and 1 43 foreign nationals in the state as a whole who have not 1 44 resided in Iowa for more than five years. The 1 45 department may reallocate funds which remain 1 46 unobligated as of March 1 of the fiscal year, based 1 47 upon demand. The department may use any relevant 1 48 source of information to determine the number of legal 1 49 immigrants and foreign nationals in the service 1 50 delivery areas and in the state. 2 1 3. A center's services and activities to persons 2 2 who are legal immigrants or foreign nationals shall 2 3 include but are not limited to all of the following: 2 4 a. Providing such persons with the name, address, 2 5 and telephone number of all providers of appropriate 2 6 English language instruction in the area. The center 2 7 may also directly or indirectly provide English 2 8 language instruction. 2 9 b. Providing information and assistance concerning 2 10 current immigration trends and laws. 2 11 c. Acting as a referral center to connect such 2 12 persons with appropriate support agencies and 2 13 programs. Services and programs may include but are 2 14 not limited to any of the following: 2 15 (1) Legal aid. 2 16 (2) Client outreach information and referral. 2 17 (3) Employment assistance in cooperation with 2 18 workforce development centers. This assistance may 2 19 include training center staff to assist legal 2 20 immigrants and foreign nationals in understanding 2 21 social and cultural mores, etiquette, business 2 22 practices, health care services, and other fundamental 2 23 information for living in Iowa. 2 24 (4) Liaison services with the United States 2 25 immigration and naturalization service and 2 26 congressional offices. 2 27 (5) Language translation of brochures and other 2 28 information directly relating to programs and services 2 29 for legal immigrants and foreign nationals that are 2 30 distributed by public and private agencies. 2 31 d. Serving as an educational resource to employers 2 32 and the public regarding concerns and issues connected 2 33 with employment of legal immigrants and foreign 2 34 nationals. 2 35 e. Providing language translation services to 2 36 assist legal immigrants and foreign nationals with 2 37 health care needs. 2 38 f. Providing language translation services to 2 39 assist legal immigrants and foreign nationals with 2 40 legal issues, including dealing with civil cases and 2 41 working cooperatively with Iowa legal aid societies 2 42 and other providers of legal services to provide the 2 43 assistance. 2 44 4. Staffing for a center may include a licensed 2 45 attorney who is knowledgeable regarding immigration 2 46 law, an education and referral counselor, support 2 47 staff, and other necessary employees. 2 48 5. A center may charge fees for services. 2 49 6. A center may receive funding from any public or 2 50 private source and expend the funding for any purpose 3 1 authorized in this section. 3 2 7. This section is repealed on July 1, 2004." 3 3 #2.
