1 1 Amend House File 761 as follow:
1 2 #1. By striking page 24, line 22 through page 25,
1 3 line 3 and inserting the following:
1 4 "1. Section 237A.3, Code 1999, is repealed on the
1 5 special effective date determined in accordance with
1 6 subsection 3A of this section.
1 7 2. Except for section 237A.3A, as amended by this
1 8 Act, which shall take effect on the special effective
1 9 date determined in accordance with subsection 3A of
1 10 this section, divisions I and II of this Act take
1 11 effect July 1, 1999. The provisions of section 237A.3
1 12 and associated administrative rules adopted under that
1 13 section shall remain applicable to a family or group
1 14 child day care home registered as of the day before
1 15 the special effective date, until the renewal date of
1 16 the registration or upon request of the home for
1 17 registration under the provisions of section 237A.3A,
1 18 as amended by this Act, whichever is earlier.
1 19 3. For unregistered family child day care homes,
1 20 the provisions of section 237A.3 and associated
1 21 administrative rules shall remain applicable for the
1 22 period of one year following the special effective
1 23 date determined in accordance with subsection 3A,
1 24 unless an unregistered home applies for registration
1 25 on or after the special effective date. The child
1 26 care home provisions of section 237A.3A, as amended by
1 27 this Act, shall apply to initial applications for
1 28 registration under chapter 237A received on or after
1 29 the special effective date.
1 30 3A. Section 237A.3A, as amended by this Act, and
1 31 the repeal of section 237A.3 shall take effect on a
1 32 date identified in an enacted appropriation providing
1 33 funding for the department of human services to make
1 34 available a sufficient ratio of home child care
1 35 consultants to adequately assist home child care
1 36 providers in implementing the provisions of section
1 37 237A.3A, as amended by this Act. The ratio shall not
1 38 be less than the ratio used by the department for
1 39 child care resource and referral agency consultants.
1 40 Until the effective date of the repeal of section
1 41 237A.3, any Code reference to section 237A.3A shall be
1 42 deemed to be to section 237A.3."
