1 3 #1. Page 9, by striking lines 29 through 31 and
1 4 inserting the following:
1 5 "1. The commissioner, within three business days
1 6 of receipt of an eligible request for an external
1 7 review, shall do all of the".
1 8 #2. Page 10, line 6, by inserting after the word
1 9 "Notify" the following: "the carrier or organized
1 10 delivery system,".
1 11 #3. Page 10, line 10, by inserting after the word
1 12 "The" the following: "carrier or organized delivery
1 13 system, the".
1 14 #4. Page 10, by striking lines 12 through 22 and
1 15 inserting the following: "independent review entity
1 16 selected by the commissioner by notifying the
1 17 commissioner within five business days of the receipt
1 18 of notice from the commissioner. If the carrier or
1 19 organized delivery system, the enrollee, or the
1 20 enrollee's treating health care provider, objects to
1 21 the independent review entity selected, the objecting
1 22 party shall have an opportunity to recommend another
1 23 independent review entity from the list certified by
1 24 the commissioner within the five-day period for
1 25 objection. If the parties agree to the independent
1 26 review entity recommended by the objecting party, that
1 27 independent review entity shall perform the external
1 28 review. If the parties fail to agree to the
1 29 independent review entity recommended by the objecting
1 30 party, the independent review entity selected by the
1 31 commissioner under paragraph "a" shall perform the
1 32 external review. The parties may waive the five-day
1 33 period for objection if all parties agree to the
1 34 independent review entity selected by the commissioner
1 35 and inform the commissioner of their agreement.
1 36 1A. The carrier or organized delivery system,
1 37 within three days after the selection of the
1 38 independent review entity that will be conducting the
1 39 external review, shall do both of the following:
1 40 a. Provide any information submitted to the
1 41 carrier or".
