  1  1    Amend the amendment, H-1078, to House File 590, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 3 the
  1  4 following:
  1  5    ""Sec.    .  Section 39.21, Code 1999, is amended
  1  6 by adding the following new subsection:
  1  7    NEW SUBSECTION.  5.  Township trustees as provided
  1  8 in section 39.22.
  1  9    Sec.    .  Section 39.21, Code 1999, is amended by
  1 10 adding the following new subsection:
  1 11    NEW SUBSECTION.  6.  Township clerk as provided in
  1 12 section 39.22.
  1 13    Sec.    .  Section 39.22, subsection 2, Code 1999,
  1 14 is amended to read as follows:
  1 15    2.  BY ELECTION.  If the county board of
  1 16 supervisors does not have the power provided under
  1 17 subsection 1 to fill the offices of trustee and clerk
  1 18 within a township by appointment, then the offices of
  1 19 township trustee and township clerk shall be filled by
  1 20 election on a nonpartisan basis.  Township trustees
  1 21 and the township clerk, in townships which do not
  1 22 include a city, shall be elected by the voters of the
  1 23 entire township.  In townships which include a city,
  1 24 the officers shall be elected by the voters of the
  1 25 township who reside outside the corporate limits of
  1 26 the city, but a township officer may be a resident of
  1 27 the city.
  1 28    a.  TOWNSHIP OFFICERS.  The election of township
  1 29 officers shall take place at the general election on
  1 30 ballots which shall not reflect a nominee's political
  1 31 affiliation.  Nomination shall be made by petition in
  1 32 accordance with chapter 45.  The petition form shall
  1 33 be furnished by the county commissioner of elections
  1 34 and shall be filed with the county commissioner of
  1 35 elections.  A plurality is sufficient to elect the
  1 36 township officers, and no primary election for the
  1 37 offices shall be held.
  1 38    a. b.  TOWNSHIP TRUSTEES.  Township trustees shall
  1 39 be elected biennially to succeed those whose terms of
  1 40 office expire on the first day of January following
  1 41 the election which is not a Sunday or legal holiday.
  1 42 The term of office of each elected township trustee is
  1 43 four years, except as provided in subsection 1 for
  1 44 initial terms following restoration of the election
  1 45 process.
  1 46    b. c.  TOWNSHIP CLERK.  At the general election
  1 47 held in the year 1990 and every four years thereafter,
  1 48 in each civil township one township clerk shall be
  1 49 elected who shall hold office for the term of four
  1 50 years."
  2  1    #2.  Page 1, by inserting after line 13 the
  2  2 following:
  2  3    "Sec.    .  Section 43.53, Code 1999, is amended to
  2  4 read as follows:
  2  5    43.53  NOMINEES FOR SUBDIVISION OFFICE – WRITE-IN
  2  6 CANDIDATES.
  2  7    The nominee of each political party for any office
  2  8 to be filled by the voters of any township or other
  2  9 political subdivision within the county shall be the
  2 10 person receiving the highest number of votes cast in
  2 11 the primary election by the voters of that party for
  2 12 the office.  That person shall appear as the party's
  2 13 candidate for the office on the general election
  2 14 ballot.  A person whose name is not printed on the
  2 15 official primary ballot shall not be declared
  2 16 nominated as a candidate for such office in the
  2 17 general election unless that person receives at least
  2 18 five votes.  Nomination of a candidate for the office
  2 19 of county supervisor elected from a district within
  2 20 the county shall be governed by section 43.52 and not
  2 21 by this section.
  2 22    Sec.    .  Section 49.37, subsection 3, Code 1999,
  2 23 is amended to read as follows:
  2 24    3.  The commissioner shall arrange the partisan
  2 25 county offices on the ballot with the board of
  2 26 supervisors first, followed by the other county
  2 27 offices and township offices in the same sequence in
  2 28 which they appear in sections 39.17 and 39.22.
  2 29 Nonpartisan offices, with the township offices first,
  2 30 shall be listed after partisan offices."
  2 31    #   .  Page 1, by inserting after line 27 the
  2 32 following:
  2 33    "Sec.    .  Section 43.21, Code 1999, is repealed."
  2 34    #   .  Title page, line 2, by inserting after the
  2 35 word "offices" the following:  "and relating to
  2 36 election of township officers"."
