  1  1    Section 1.  Section 256.12, subsection 2, unnumbered
  1  2 paragraph 1, Code 1997, is amended to read as follows:
  1  3    This section does not deprive the respective boards of
  1  4 public school districts of any of their legal powers,
  1  5 statutory or otherwise, and in accepting the specially
  1  6 enrolled students, each of the boards shall prescribe the
  1  7 terms of the special enrollment, including but not limited to
  1  8 scheduling of courses and the length of class periods.  In
  1  9 addition, the board of the affected public school district
  1 10 shall be given notice by the department of its decision to
  1 11 permit the special enrollment not later than six months prior
  1 12 to the opening of the affected public school district's school
  1 13 year, except that the board of the public school district may
  1 14 waive the notice requirement.  School districts and area
  1 15 education agency boards shall make public school services,
  1 16 which shall include special education programs and services
  1 17 and may include health services, services for remedial
  1 18 education programs, guidance services, and school testing
  1 19 services, available to children attending nonpublic schools in
  1 20 the same manner and to the same extent that they are provided
  1 21 to public school students.  However, services that are made
  1 22 available shall be provided on neutral sites, or in mobile
  1 23 units located off the nonpublic school premises as determined
  1 24 by the boards of the school districts and area education
  1 25 agencies providing the services, and not on nonpublic school
  1 26 property, except for services for remedial education programs,
  1 27 health services, diagnostic services for speech, hearing, and
  1 28 psychological purposes, and assistance with physical and
  1 29 communication needs of students with physical disabilities,
  1 30 and services of an educational interpreter, which may be
  1 31 provided on nonpublic school premises, with the permission of
  1 32 the lawful custodian.  
  1 33                           EXPLANATION
  1 34    This bill adds services for remedial education programs to
  1 35 the list of public school services in Code section 256.12,
  2  1 subsection 2, which may be provided to nonpublic school
  2  2 students on nonpublic school premises.  Services for remedial
  2  3 education programs are included in the list of public school
  2  4 services which may be provided to children attending nonpublic
  2  5 schools, but Code section 256.12 currently provides that the
  2  6 services must be made available on neutral sites, or in mobile
  2  7 units located off of nonpublic school premises.
