1 1 Section 1. Section 23A.2, subsection 10, Code 1997, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. m. The repair, calibration, or maintenance
1 4 of radiological detection equipment by the emergency
1 5 management division of the department of public defense.
1 6 Sec. 2. Section 29C.8, Code 1997, is amended by adding the
1 7 following new subsection:
1 8 NEW SUBSECTION. 5. The emergency management division may
1 9 charge fees for the repair, calibration, or maintenance of
1 10 radiological detection equipment and may expend funds in
1 11 addition to funds budgeted for the servicing of the
1 12 radiological detection equipment. The division shall adopt
1 13 rules pursuant to chapter 17A providing for the establishment
1 14 and collection of fees for radiological detection equipment
1 15 repair, calibration, or maintenance services and for entering
1 16 into agreements with other public and private entities to
1 17 provide the services. Fees collected for repair, calibration,
1 18 or maintenance services shall be treated as repayment receipts
1 19 as defined in section 8.2 and shall be used for the operation
1 20 of the division's radiological maintenance facility or
1 21 radiation incident response training.
1 22 EXPLANATION
1 23 This bill exempts the provision of repair, calibration, or
1 24 maintenance services by the emergency management division of
1 25 the department of public defense from state law which
1 26 prohibits state competition with private enterprise. The bill
1 27 also authorizes the division to charge fees for the provision
1 28 of repair, calibration, or maintenance services for
1 29 radiological detection equipment. Fees charged, if any, are
1 30 to be treated as repayment receipts under section 8.2 and are
1 31 to be used for the operation of the radiological maintenance
1 32 facility or for radiation incident response training.
