  1  1    Section 1.  Section 481C.2, Code Supplement 1997, is
  1  2 amended to read as follows:
  1  3    481C.2  DUTIES.
  1  4    The director of the department of natural resources shall
  1  5 enter into a memorandum of agreement with the United States
  1  6 department of agriculture, animal damage control division.
  1  7 The wild animal depredation unit shall serve and act as the
  1  8 liaison to the department for the producers in the state who
  1  9 suffer crop and nursery damage due to wild animals.  The
  1 10 department shall issue depredation permits as necessary to
  1 11 reduce crop and nursery damage due to wild animals.  The
  1 12 criteria for issuing depredation permits shall be established
  1 13 in administrative rules in consultation with the farmer
  1 14 advisory committee created in section 481A.10A.  The
  1 15 administrative rules adopted pursuant to this section shall
  1 16 not require a producer to erect fencing at a cost exceeding
  1 17 one thousand five hundred dollars as a requisite for receiving
  1 18 a depredation permit or for participation in a depredation
  1 19 plan.
  1 20    Sec. 2.  Section 483A.8, subsection 3, Code 1997, is
  1 21 amended to read as follows:
  1 22    3.  A nonresident deer hunter is required to have only a
  1 23 nonresident deer license and a wildlife habitat stamp.  The
  1 24 commission shall annually limit to five thousand licenses the
  1 25 number of nonresidents allowed to have deer hunting licenses.
  1 26 The number of nonresident deer hunting licenses shall be
  1 27 determined as provided in section 481A.38.  The commission
  1 28 shall allocate the nonresident deer hunting licenses issued
  1 29 among the zones based on the populations of deer.  However, a
  1 30 nonresident applicant may request one or more hunting zones,
  1 31 in order of preference, in which the applicant wishes to hunt.
  1 32 If the request cannot be fulfilled, the applicable fees shall
  1 33 be returned to the applicant.  A nonresident applying for a
  1 34 deer hunting license must exhibit proof of having successfully
  1 35 completed a hunter safety and ethics education program as
  2  1 provided in section 483A.27 or its equivalent as determined by
  2  2 the department before the license is issued.  
  2  3                           EXPLANATION 
  2  4    This bill prohibits the department of natural resources
  2  5 from requiring the erection of fencing which costs more than
  2  6 $1,500 as a requisite for being issued a depredation permit or
  2  7 for participating in a depredation plan.
  2  8    The bill also strikes the maximum annual limit of 5,000
  2  9 deer hunting licenses for nonresidents.  The number of annual
  2 10 nonresident deer hunting licenses will be set by the natural
  2 11 resource commission based on population and other factors.
