  1  1    Section 1.  Section 142C.15, subsection 4, paragraphs b and
  1  2 c, Code 1997, are amended to read as follows:
  1  3    b.  Not more than thirty percent of the moneys in the fund
  1  4 annually may be expended in the form of grants to hospitals
  1  5 for reimbursement for costs directly related to the
  1  6 development of in-hospital anatomical gift public awareness
  1  7 projects, anatomical gift referral protocols, and associated
  1  8 administrative expenses.  As a condition of receiving a grant,
  1  9 a hospital shall demonstrate, through documentation, that the
  1 10 hospital, during the previous calendar year, properly complied
  1 11 with in-hospital anatomical gift request protocols for at
  1 12 least eighty percent of all deaths occurring in the hospital
  1 13 at a percentage rate which places the hospital in the upper
  1 14 fifty percent of all protocol compliance rates for hospitals
  1 15 submitting documentation for cost reimbursement under this
  1 16 section.
  1 17    c.  Not more than fifty percent of the moneys in the fund
  1 18 annually may be expended in the form of grants to hospitals
  1 19 which perform heart, lung, liver, pancreas, or kidney
  1 20 transplants.  As a condition of receiving a grant, a hospital
  1 21 shall demonstrate, through documentation, that the hospital,
  1 22 during the previous calendar year, properly complied with in-
  1 23 hospital anatomical gift request protocols for at least eighty
  1 24 percent of all deaths occurring in the hospital at a
  1 25 percentage rate which places the hospital in the upper fifty
  1 26 percent of all protocol compliance rates for hospitals
  1 27 submitting documentation for cost reimbursement under this
  1 28 section.  The hospital shall submit an application on behalf
  1 29 of a patient requiring a transplant in the amount of the costs
  1 30 associated with the following, if funds are not available from
  1 31 any other third-party payor:
  1 32    (1)  The costs of the organ transplantation procedure.
  1 33    (2)  The costs of post-transplantation drug or other
  1 34 therapy.
  1 35    (3)  Other transplantation costs including but not limited
  2  1 to food, lodging, and transportation.
  2  2    Sec. 2.  NEW SECTION.  142C.17  ANNUAL DONATION AND
  2  3 COMPLIANCE REPORT.
  2  4    The Iowa department of public health, in conjunction with
  2  5 any statewide organ procurement organization in Iowa, shall
  2  6 prepare and submit a report to the general assembly on or
  2  7 before January 1 each year regarding organ donation rates and
  2  8 voluntary compliance efforts with hospital organ and tissue
  2  9 donation protocols by physicians, hospitals, and other health
  2 10 systems organizations.  The report shall contain the
  2 11 following:
  2 12    1.  An evaluation of organ procurement efforts in the
  2 13 state, including statistics regarding organ and tissue
  2 14 donation activity as of September 30 of the preceding year.
  2 15    2.  Efforts by any statewide organ procurement organization
  2 16 in Iowa, and related parties, to increase organ and tissue
  2 17 donation and consent rates.
  2 18    3.  Voluntary compliance efforts with hospital organ and
  2 19 tissue donation protocols by physicians, hospitals, and health
  2 20 systems organizations and the results of those efforts.
  2 21    4.  Annual contribution levels to the anatomical gift
  2 22 public awareness and transplantation fund created in section
  2 23 142C.15, and any distributions made from the fund.
  2 24    5.  Efforts and ideas for increasing public awareness of
  2 25 the option of organ and tissue donation.
  2 26    6.  Additional information deemed relevant by the
  2 27 department in assessing the status and progress of organ and
  2 28 tissue donation efforts in the state.  
  2 29                           EXPLANATION
  2 30    This bill requires the Iowa department of public health, in
  2 31 conjunction with any statewide organ procurement organization,
  2 32 to prepare and submit a report to the general assembly on or
  2 33 before January 1 each year regarding organ donation rates and
  2 34 voluntary compliance efforts with hospital organ and tissue
  2 35 donation protocols by physicians, hospitals, and other health
  3  1 systems organizations.  The report is required to contain an
  3  2 evaluation of organ procurement efforts in the state,
  3  3 including statistics regarding organ and tissue donation
  3  4 activity as of September 30 of the preceding year, efforts by
  3  5 any statewide organ procurement organization and related
  3  6 parties to increase organ and tissue donation and consent
  3  7 rates, voluntary compliance efforts with hospital organ and
  3  8 tissue donation protocols by physicians, hospitals, and health
  3  9 systems organizations and the results of those efforts, annual
  3 10 contribution levels to the anatomical gift public awareness
  3 11 and transplantation fund created in Code section 142C.15 and
  3 12 any distributions made from the fund, efforts and ideas for
  3 13 increasing public awareness of the option of organ and tissue
  3 14 donation, and any additional information which is determined
  3 15 to be relevant by the department in assessing the status and
  3 16 progress of organ and tissue donation efforts in the state of
  3 17 Iowa.
  3 18    The bill also provides for a change in the threshold
  3 19 protocol compliance rate in order for hospitals to qualify for
  3 20 anatomical gift public awareness and transplantation fund
  3 21 reimbursement grants pursuant to Code section 142C.15,
  3 22 subsection 4, paragraphs "b" and "c".  Currently, hospitals
  3 23 must submit documentation that they are observing organ and
  3 24 tissue donation protocols for at least 80 percent of all
  3 25 patient deaths in that hospital in order to receive grants
  3 26 providing reimbursement for the development and administration
  3 27 of organ donation procedures, and expenses related to
  3 28 performing organ and tissue transplant operations.  The bill
  3 29 provides for a new compliance requirement that a hospital has
  3 30 achieved a rate of compliance with organ donation procedure
  3 31 protocols in the top 50 percent of all hospitals submitting
  3 32 documentation to be considered eligible for a reimbursement
  3 33 grant.
