  1  1    Section 1.  Section 159.6, subsection 7, Code 1997, is
  1  2 amended by striking the subsection.
  1  3    Sec. 2.  Section 159.6, subsection 9, Code 1997, is amended
  1  4 to read as follows:
  1  5    9.  State aid received by certain associations as provided
  1  6 in chapters 176 through 183 182, 186, and 352.
  1  7    Sec. 3.  Section 159.20, subsection 5, Code 1997, is
  1  8 amended to read as follows:
  1  9    5.  Accumulate and diffuse information concerning the
  1 10 marketing of agricultural commodities in cooperation with
  1 11 persons, agencies, or the federal government.  The department
  1 12 shall establish an agricultural commodity informational data
  1 13 base.
  1 14    Sec. 4.  Section 172A.6, unnumbered paragraph 1, Code 1997,
  1 15 is amended to read as follows:
  1 16    The license and financial responsibility provisions of this
  1 17 chapter shall not apply to any person who is licensed by the
  1 18 secretary as provided in chapter 137A, 171 or 172 and who
  1 19 purchases livestock for slaughter valued at less than an
  1 20 average daily value of two thousand five hundred dollars
  1 21 during the preceding twelve months or such part thereof as the
  1 22 person was purchasing livestock. Said licensees are made
  1 23 subject to this chapter as to the regulatory and penal
  1 24 provisions hereof. All other provisions of this chapter shall
  1 25 apply to said dealers or brokers.
  1 26    Sec. 5.  Section 173.3, Code 1997, is amended to read as
  1 27 follows:
  1 28    173.3  CERTIFICATION OF STATE AID ASSOCIATIONS.
  1 29    On or before November 15 of each year, the secretary of
  1 30 agriculture shall certify to the secretary of the state fair
  1 31 board the names of the various associations and societies
  1 32 which have qualified for state aid under the provisions of
  1 33 chapters 176 through 178, 180 through 183 181, 182, 186, and
  1 34 352, and which are entitled to representation in the
  1 35 convention as provided in section 173.2.
  2  1    Sec. 6.  Section 190.2, unnumbered paragraph 1, Code 1997,
  2  2 is amended to read as follows:
  2  3    The department may establish and publish standards for
  2  4 foods when such standards are not fixed by law, but the same.
  2  5 The standards shall conform with those proclaimed standards
  2  6 for foods adopted by the secretary of agriculture of federal
  2  7 agencies including, but not limited to, the United States
  2  8 department of agriculture.
  2  9    Sec. 5. Section 198.9, subsection 3, unnumbered paragraph
  2 10 2, Code 1997, is amended by striking the paragraph.
  2 11    Sec. 7.  Section 331.507, subsection 3, Code 1997, is
  2 12 amended by striking the subsection.
  2 13    Sec. 8.  Chapters 171, 180, 183, and 190A, Code 1997, are
  2 14 repealed.
  2 15    Sec. 9.  Sections 159.12, 159.18, 159.34, 160.11, 160.16,
  2 16 172.5, 213.4, 213.5, 213.6, and 352.13, Code 1997, are
  2 17 repealed.
  2 18    Sec. 10.  DIRECTIONS TO THE CODE EDITOR.  The Code editor
  2 19 shall transfer the provisions of chapter 196A to or near
  2 20 chapter 184.  
  2 21                           EXPLANATION
  2 22    This bill amends a number of provisions relating to
  2 23 agriculture and the department of agriculture and land
  2 24 stewardship.
  2 25    Code section 159.6 is amended by striking an internal Code
  2 26 chapter reference to the regulation of Code storage facilities
  2 27 which chapter is repealed later on in the bill.
  2 28    Code section 159.20 is amended by striking a provision
  2 29 which requires the department of agriculture and land
  2 30 stewardship to establish an agricultural commodity
  2 31 informational database.
  2 32    Code section 190.2 is amended by providing that when the
  2 33 department of agriculture and land stewardship adopts
  2 34 standards for foods under Code chapter 190, the standards must
  2 35 comply with standards adopted by any federal agencies, not
  3  1 just the United States department of agriculture.
  3  2    Code section 198.9 is amended by striking a provision
  3  3 requiring the department of agriculture and land stewardship
  3  4 to publish an annual report involving inspection fees for
  3  5 commercial fertilizer.
  3  6    Code section 331.507 is amended by striking an internal
  3  7 Code section reference requiring the auditor to collect a bee
  3  8 entry fee which section is repealed later in the bill.
  3  9    Code chapter 171 is repealed.  The chapter regulates cold
  3 10 storage plants by providing for licensure, examination of
  3 11 plants, reporting, and penalties.
  3 12    Code chapter 180 is repealed.  The chapter authorizes the
  3 13 Iowa state dairy association to hold an exposition of 4-H
  3 14 dairy calves and contests.
  3 15    Code chapter 183 is repealed.  The chapter memorializes the
  3 16 interstate compact on agricultural grain marketing.
  3 17    Code chapter 190A is repealed.  The chapter regulates
  3 18 frozen desserts by providing for minimum requirements,
  3 19 regulating fruit flavoring, providing labeling requirements,
  3 20 prohibiting false advertising, requiring the posting of sign,
  3 21 and providing for dry powder mixes.
  3 22    Code section 159.12 is repealed.  The section requires
  3 23 persons answering departmental inquiries regarding
  3 24 agricultural statistics to summarize and footnote their
  3 25 responses.
  3 26    Code section 159.18 is repealed.  This section allows the
  3 27 department to hold a state farmers institute, for the
  3 28 discussion of practical and scientific topics relating to the
  3 29 various branches of agriculture.
  3 30    Code section 159.34 is repealed.  The section authorizes
  3 31 the department to establish standards for apples, and allows
  3 32 for departmental inspections and certification of apples.
  3 33    Code section 160.11 is repealed.  The section provides that
  3 34 regulations and orders adopted by the department in regulating
  3 35 bee colonies under Code chapter 160 have the full force and
  4  1 effect of law.
  4  2    Code section 160.16 is repealed.  The section requires that
  4  3 each bee colony moved into Iowa from another state by a
  4  4 nonresident be assessed a one dollar entry fee.
  4  5    Code sections 213.4 through 213.6 are repealed.  Code
  4  6 chapter 213 regulates weights and measures related to
  4  7 agricultural commodities.  The repealed sections provide for
  4  8 the sealing of bottles for milk or cream, the authority of a
  4  9 city to appoint a sealer of weights and measures, and the duty
  4 10 of a city sealer to provide for the safekeeping of city
  4 11 standards.
  4 12    Code section 352.13 is repealed.  The section abolishes the
  4 13 state interagency resource council which was charged to
  4 14 receive and distribute information regarding land use
  4 15 statistics by counties.
