1 1 Section 1. Section 483A.1, subsection 6, Code 1997, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. i. Hunting guide license ..$ 25.00
1 4 Sec. 2. NEW SECTION. 483A.28 HUNTING GUIDE LICENSE –
1 5 PENALTY.
1 6 1. A person shall not engage in or be employed for any
1 7 compensation or reward for guiding, directing, or assisting
1 8 another person in hunting game in this state unless the person
1 9 has obtained a hunting guide license from the department.
1 10 2. Upon application and payment of the hunting guide
1 11 license fee as provided in section 483A.1, the department
1 12 shall issue a hunting guide license to an applicant who is a
1 13 resident of this state, who agrees to faithfully perform the
1 14 duties and responsibilities of a licensed hunting guide, and
1 15 who agrees to observe and comply with requirements of chapters
1 16 481A and 484A, and this chapter, and the rules of the
1 17 department relating to hunting guides and the hunting of game.
1 18 A hunting guide is responsible for informing hunting clients
1 19 of all applicable hunting laws and rules. A hunting guide
1 20 license shall not be issued to a person who is under eighteen
1 21 years of age.
1 22 3. The department shall provide hunting guides with
1 23 hunting license and permit applications for their nonresident
1 24 clients.
1 25 4. Section 483A.26 shall apply to a nonresident who
1 26 falsely claims residence in this state to obtain a hunting
1 27 guide license.
1 28 5. A violation of this section is a simple misdemeanor and
1 29 is punishable as provided in section 483A.42.
1 30 EXPLANATION
1 31 This bill provides for the licensing of persons who provide
1 32 hunting guide services. The department of natural resources
1 33 is directed to issue hunting guide licenses, upon application
1 34 and payment of an annual fee of $25, to residents of this
1 35 state who agree to faithfully perform the duties and
2 1 responsibilities of a licensed hunting guide and to observe
2 2 and comply with the requirements of the hunting laws and rules
2 3 of the department. A hunting guide must be at least 18 years
2 4 of age to be licensed.
2 5 Violators are guilty of a simple misdemeanor and subject to
2 6 a minimum fine of $10 for each offense.
