  1  2                        RECKLESS DRIVING
  1  3    Section 1.  Section 321.209, subsection 5, Code 1997, is
  1  4 amended to read as follows:
  1  5    5.  Conviction, or forfeiture of bail not vacated, upon two
  1  6 charges of reckless driving.  
  1  7                           DIVISION II
  1  8                   CERTAIN SPEEDING VIOLATIONS
  1  9    Sec. 2.  Section 321.210, subsection 2, paragraph d, Code
  1 10 Supplement 1997, is amended by striking the paragraph.
  1 11    Sec. 3.  Section 321A.3, subsection 4, Code 1997, is
  1 12 amended by striking the subsection.
  1 13    Sec. 4.  Section 516B.3, Code 1997, is repealed.  
  1 14                          DIVISION III
  1 15             FRAUDULENT ACTS AND MOTOR VEHICLE SALES
  1 16    Sec. 5.  Section 322.3, Code Supplement 1997, is amended by
  1 17 adding the following new subsection:
  1 18    NEW SUBSECTION.  12.  A person convicted of a fraudulent
  1 19 act in connection with selling, bartering, or otherwise
  1 20 dealing in motor vehicles, in this state or any other state,
  1 21 shall not for a period of five years from the date of
  1 22 conviction be an owner, salesperson, officer of a corporation,
  1 23 or dealer representative of a licensed motor vehicle dealer or
  1 24 represent themselves as an owner, salesperson, or dealer
  1 25 representative of a licensed motor vehicle dealer.  
  1 26                           DIVISION IV
  1 27      MULTIYEAR MOTOR VEHICLE AND VEHICLE DEALER LICENSING
  1 28    Sec. 6.  Section 322B.3, subsection 2, unnumbered paragraph
  1 29 2, Code 1997, is amended by striking the unnumbered paragraph.
  1 30    Sec. 7.  Section 322C.4, subsection 2, unnumbered paragraph
  1 31 2, Code Supplement 1997, is amended by striking the unnumbered
  1 32 paragraph.
  1 33    Sec. 8.  Sections 321.64, 321F.4A, 321H.4A, and 322.7A,
  1 34 Code 1997, are repealed.  
  1 35                           EXPLANATION
  2  1    This bill relates to state department of transportation
  2  2 responsibilities in the areas of driver's license revocation,
  2  3 speeding violations, motor vehicle dealer sales, and multiyear
  2  4 motor vehicle licensing.
  2  5    Division I.  Code section 321.209 is amended to require
  2  6 revocation of a driver's license or operating privilege upon
  2  7 the first conviction or forfeiture of bail for reckless
  2  8 driving.  The revocation period is stipulated in current Code
  2  9 section 321.212, subsection 1, paragraph "b".  Current law
  2 10 only requires such revocation upon a second conviction for
  2 11 reckless driving.
  2 12    Division II.  Code section 321.210 is amended to delete the
  2 13 provision which prohibits the department, for purposes of
  2 14 suspending driver's licenses, from considering the first two
  2 15 speeding violations within any 12-month period of 10 miles per
  2 16 hour or less over the legal speed limit between 34 miles per
  2 17 hour and 56 miles per hour.  Coordinating amendments are made
  2 18 to Code sections 321A.3 and 516B.3 with respect to operating
  2 19 record abstracts and insurance rates.
  2 20    Division III.  Code section 322.3 is amended to prohibit
  2 21 any person who has been convicted of a fraudulent act in
  2 22 selling, bartering, or otherwise dealing in motor vehicles, in
  2 23 this state or any other state, from being an owner,
  2 24 salesperson, or dealer representative of a licensed motor
  2 25 vehicle dealer.  The prohibition is based on conduct which
  2 26 under current Code section 322.6 would allow the department to
  2 27 deny an application for a motor vehicle dealer license.  The
  2 28 prohibition would apply for five years following such a
  2 29 conviction.
  2 30    Division IV.  Code sections 322B.3 and 322C.4 are amended
  2 31 and Code sections 321.64, 321F.4A, 321H.4A, and 322.7A are
  2 32 repealed to eliminate from the Code certain provisions for
  2 33 prorating motor vehicle and vehicle dealer license fees in the
  2 34 transition from single year to multiyear licensing.
