  1  1    Section 1.  Section 341A.11, unnumbered paragraph 1, Code
  1  2 1997, is amended to read as follows:
  1  3    The tenure of every deputy sheriff holding an office or
  1  4 position of employment under the provisions of this chapter
  1  5 shall be conditional upon a probationary period of not more
  1  6 than twelve months, and where such deputy sheriff attends the
  1  7 law enforcement academy or a regional training facility
  1  8 certified by the director of the Iowa law enforcement academy,
  1  9 a probationary period of not more than six months, during
  1 10 which time the appointee may be removed or discharged by the
  1 11 sheriff.  Thereafter If the employee holds a current Iowa law
  1 12 enforcement peace officer certification by the Iowa law
  1 13 enforcement academy or by a regional training facility
  1 14 certified by the director of the Iowa law enforcement academy
  1 15 prior to initial appointment as a deputy sheriff, the
  1 16 probationary period shall be for a period of six months and
  1 17 shall commence with the date of initial appointment as a
  1 18 deputy sheriff.  If the employee does not hold a current Iowa
  1 19 law enforcement peace officer certification by the Iowa law
  1 20 enforcement academy or by a regional training facility
  1 21 certified by the director of the Iowa law enforcement academy
  1 22 prior to initial appointment as a deputy sheriff, the
  1 23 probationary period shall be for a period of at least six
  1 24 months following the date of certification as a peace officer
  1 25 as certified by the director of the Iowa law enforcement
  1 26 academy, or eighteen months from the date of initial
  1 27 appointment as a deputy sheriff.  After the probationary
  1 28 period, the deputy sheriff may be removed or discharged,
  1 29 suspended without pay, demoted, or reduced in rank, or
  1 30 deprived of vacation privileges or other privileges for any of
  1 31 the following reasons:  
  1 32                           EXPLANATION
  1 33    The bill provides for the extension of the probationary
  1 34 employment period for deputy sheriffs.  If a deputy sheriff
  1 35 holds a current Iowa law enforcement peace officer
  2  1 certification by the Iowa law enforcement academy or by a
  2  2 regional training facility certified by the director of the
  2  3 Iowa law enforcement academy, the probationary period is six
  2  4 months from the date of initial appointment.  If the employee
  2  5 does not hold a current Iowa law enforcement peace officer
  2  6 certification by the Iowa law enforcement academy or other
  2  7 certified regional training facility, the probationary period
  2  8 shall be for a period of at least six months following the
  2  9 date of certification as a peace officer, or 18 months from
  2 10 the date of initial appointment as a deputy sheriff.
