  1  1    Section 1.  Section 321.65, Code 1997, is amended to read
  1  2 as follows:
  1  3    321.65  GARAGE RECORD.
  1  4    1.  Every person or corporation operating a public garage
  1  5 and every person licensed under chapter 321H or 322 shall keep
  1  6 for public inspection a record of the registration plate
  1  7 number and engine or factory serial number and vehicle
  1  8 identification number of every motor vehicle ten model years
  1  9 old or newer which is offered for sale or taken.  The person
  1 10 shall verify that the federal motor vehicle certification
  1 11 label and component part numbers are consistent with the
  1 12 vehicle identification number and shall record any
  1 13 inconsistency.
  1 14    2.  Every person operating a garage and every person
  1 15 licensed under chapter 321H or 322 who takes motor vehicles in
  1 16 for repairs in said a garage shall record the vehicle
  1 17 identification number, the registration plate number of the
  1 18 motor vehicle, the component part number of any component part
  1 19 removed, and the component part number of any replacement
  1 20 component part.  The records specified under this subsection
  1 21 are required only for motor vehicles which are ten model years
  1 22 old or newer.
  1 23    Sec. 2.  Section 321.66, Code 1997, is amended to read as
  1 24 follows:
  1 25    321.66  DUTY TO HOLD VEHICLES.
  1 26    The proprietor of Every person operating a garage, every
  1 27 person licensed under chapter 321H or 322, and the
  1 28 proprietor's any employees of persons operating a garage or
  1 29 licensed under chapter 321H or 322, upon discovering that the
  1 30 engine vehicle identification number, federal motor vehicle
  1 31 certification label, component part number, or state assigned
  1 32 identification number of a motor vehicle has been altered or,
  1 33 obliterated, removed, or covered shall immediately notify some
  1 34 member of the department or peace officer of the county in
  1 35 which the garage is located or the Iowa highway safety patrol,
  2  1 and hold said that vehicle or component part for a period of
  2  2 twenty-four hours or until an investigation shall have been is
  2  3 made by such a peace officer.
  2  4    Sec. 3.  Section 321.81, Code 1997, is amended to read as
  2  5 follows:
  2  6    321.81  PRESUMPTIVE EVIDENCE.
  2  7    Whoever shall conceal, barter, sell, possess, or dispose of
  2  8 any vehicle or, component part, or air bag which has been
  2  9 stolen, or shall disguise, alter, remove, or change such
  2 10 vehicle, or component part, or air bag, or the vehicle
  2 11 identification number or, federal motor vehicle certification
  2 12 label, state-assigned identification number, component part
  2 13 number, or air bag number thereof, or remove or change the
  2 14 registration plate number thereon, or do any act designed to
  2 15 prevent identification of such vehicle or, component part, or
  2 16 air bag, shall be presumed to have knowledge that such vehicle
  2 17 or, component part, or air bag had been stolen.
  2 18    Sec. 4.  Section 321.96, Code 1997, is amended to read as
  2 19 follows:
  2 20    321.96  PROHIBITED PLATES – CERTIFICATES.
  2 21    A person shall not display or cause or permit to be
  2 22 displayed, or have in the person's possession, a vehicle
  2 23 identification number that has been assigned by the
  2 24 manufacturer or the department, or any agency or department of
  2 25 any other state that is authorized to assign vehicle
  2 26 identification numbers, or a component part number, rosette
  2 27 rivet, or federal motor vehicle certification label except as
  2 28 provided in this chapter, or a canceled, revoked, altered, or
  2 29 fictitious registration plate number plates, registration
  2 30 receipt, or certificate of title, as the same are respectively
  2 31 provided for in this chapter.
  2 32    Sec. 5.  Section 321.95, Code 1997, is amended by striking
  2 33 the words "public garage" and inserting the word "garage".  
  2 34                           EXPLANATION
  2 35    This bill makes changes in various requirements pertaining
  3  1 to the identification numbers used on motor vehicles and
  3  2 various parts of motor vehicles.  The bill adds vehicle
  3  3 identification numbers and component part numbers to the list
  3  4 of numbers that must be recorded and kept by a garage owner, a
  3  5 person licensed as a vehicle recycler or rebuilder, or a motor
  3  6 vehicle manufacturer, distributor, or dealer.  Those same
  3  7 individuals are required to notify a member of the department
  3  8 of transportation or a peace officer or member of the Iowa
  3  9 highway safety patrol, upon discovering that a vehicle
  3 10 identification number, a federal motor vehicle certification
  3 11 label, component part number, or state-assigned identification
  3 12 number has been altered, obliterated, removed, or covered.
  3 13 The vehicle or component part with the damaged or covered
  3 14 numbers is to be held for 24 hours or until the matter is
  3 15 investigated.
  3 16    The presumption that an individual who has or disposes of
  3 17 any vehicle or component part which has an altered vehicle or
  3 18 component part identification number knows that the vehicle or
  3 19 component part is stolen is amended in the bill to include air
  3 20 bags and to include federal motor vehicle certification
  3 21 labels, state-assigned identification numbers, and air bag
  3 22 numbers among the numbers that trigger the presumption.
  3 23    The bill adds to those items that may not be displayed or
  3 24 possessed except by authorized persons any vehicle
  3 25 identification number that has been assigned by the
  3 26 manufacturer or the department or any other agency or
  3 27 department, any rosette rivet, or federal motor vehicle
  3 28 certification label.
  3 29    The bill also makes a terminology change to conform the
  3 30 usage of the term "garage" to the definition of the term in
  3 31 chapter 321.
  3 32    Violations of the motor vehicle chapter 321, which are not
  3 33 otherwise specified as serious or aggravated misdemeanors or
  3 34 some form of felony, are simple misdemeanors under Iowa Code
  3 35 section 321.482.  A simple misdemeanor is punishable by a fine
  4  1 of not less than $50, but not more than $100, or imprisonment
  4  2 not to exceed 30 days.
