1 1 Section 1. Section 712.9, Code 1997, is amended to read as
1 2 follows:
1 3 712.9 VIOLATIONS OF INDIVIDUAL RIGHTS – PENALTIES.
1 4 A violation of section 712.2, which is also a hate crime as
1 5 defined in section 729A.2, shall be punished by a ten-year
1 6 sentence in addition to the penalty already provided for the
1 7 underlying offense. A violation of sections 712.3 through
1 8 712.8, which is also a hate crime as defined in section
1 9 729A.2, shall be classified and punished as an offense one
1 10 degree higher than the underlying offense.
1 11 EXPLANATION
1 12 This bill provides for an additional 10-year sentence for
1 13 persons who commit the crime of arson in the first degree, if
1 14 the offense is committed as a hate crime. A hate crime, under
1 15 Code section 729A.2, is a crime which is committed against a
1 16 person or a person's property because of the person's race,
1 17 color, religion, ancestry, national origin, political
1 18 affiliation, sex, sexual orientation, age, or disability, or
1 19 because of the person's association with a person of a certain
1 20 race, color, religion, ancestry, national origin, political
1 21 affiliation, sex, sexual orientation, age, or disability.
1 22 Arson in the first degree is a class "B" felony. Class "B"
1 23 felons are to be confined for no more than 25 years.
