1 1 Section 1. Section 455D.3, subsection 3, Code 1997, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. c. In determining whether a planning area
1 4 has met or exceeded the goals designated in this section for
1 5 reducing the waste stream, the department shall credit against
1 6 any volumes in excess of the stated goals all of the following
1 7 materials:
1 8 (1) All bottles and cans diverted away from the sanitary
1 9 landfills in the planning area under chapter 455C.
1 10 (2) All scrap metals diverted away from the sanitary
1 11 landfills in the planning area including, but not limited to,
1 12 industrial process scrap and junk cars that are recycled for
1 13 scrap metal.
1 14 (3) All sludge that is diverted away from the sanitary
1 15 landfills in a planning area.
1 16 EXPLANATION
1 17 This bill relates to the determination by the department of
1 18 natural resources of whether planning areas have met the waste
1 19 stream reduction goals stated in Code section 455D.3. The
1 20 bill provides that, in making this determination, the
1 21 department shall credit against any volumes in excess of the
1 22 stated goals all of the following:
1 23 1. All bottles and cans diverted away from landfills.
1 24 2. All scrap metal diverted away from landfills. Scrap
1 25 metal includes, but is not limited to industrial process scrap
1 26 and junk car s that are recycled for scrap metal.
1 27 3. All sludge diverted away from landfills.
