  1  1    Section 1.  DISASTER EMERGENCY SCHOOL CALENDAR WAIVER.  For
  1  2 the school year beginning July 1, 1996, and ending June 30,
  1  3 1997, the director of the department of education may waive
  1  4 the one-hundred-eighty-day school calendar requirement set
  1  5 forth in section 279.10, subsection 1, for an accredited
  1  6 nonpublic school or public school district that submits a
  1  7 written request if the school or school district is located in
  1  8 a county proclaimed by the governor to be a disaster emergency
  1  9 area.  To be eligible for a waiver under this section, the
  1 10 school or school district's calendar shall have been reduced
  1 11 only by the number of days in which the county experienced
  1 12 disaster conditions and during which the proclamation was in
  1 13 effect.
  1 14    Sec. 2.  This Act, being deemed of immediate importance,
  1 15 takes effect upon enactment.  
  1 16                           EXPLANATION
  1 17    This bill authorizes the director of the department of
  1 18 education to waive, during the school year beginning July 1,
  1 19 1996, and ending June 30, 1997, the 180-day school calendar
  1 20 requirement set forth in section 279.10, subsection 1, for
  1 21 accredited nonpublic schools and school districts located in a
  1 22 county proclaimed by the governor to be a disaster emergency
  1 23 area.
  1 24    The governor issued such a proclamation on January 29 for
  1 25 the following counties, which have experienced several severe
  1 26 winter storm systems since January 9, 1997:  Cherokee, Clay,
  1 27 Dickinson, Emmet, Kossuth, Lyon, O'Brien, Osceola, Palo Alto,
  1 28 Plymouth, and Sioux counties.  To be eligible for a waiver, a
  1 29 school or school district located in one of these counties
  1 30 shall submit a written request to the director, and the school
  1 31 or school district's calendar shall have been reduced only by
  1 32 the number of days in which the county experienced disaster
  1 33 conditions and during which the proclamation was in effect.
  1 34    The bill takes effect upon enactment.
