  1  1    Section 1.  Section 331.651, subsection 1, paragraph c,
  1  2 Code 1997, is amended to read as follows:
  1  3    c.  Be Is a certified peace officer recognized certified
  1  4 within one year of taking office by the Iowa law enforcement
  1  5 academy council under chapter 80B or complete the basic
  1  6 training course provided at and who shall maintain
  1  7 certification by the Iowa law enforcement academy's central
  1  8 training facility or a location other than the central
  1  9 training facility within one year of taking office academy
  1 10 while in office.  A person shall be deemed to have completed
  1 11 the basic training course if the person meets all course
  1 12 requirements except the physical training requirements.  
  1 13                           EXPLANATION
  1 14    This bill adds to the qualifications that a person elected
  1 15 or appointed to the office of county sheriff must meet.
  1 16    Currently, to be qualified as an elected or appointed
  1 17 sheriff, a person must either be a certified peace officer or
  1 18 complete the basic training course at the Iowa law enforcement
  1 19 academy's central training facility, or at another location,
  1 20 within one year of taking office.  Therefore, the sheriff may
  1 21 be certified, but is not compelled to meet certification
  1 22 requirements, only to successfully pass the training.  The
  1 23 Code also exempts sheriffs from the Iowa law enforcement
  1 24 academy's physical training requirements.
  1 25    The bill requires a sheriff to be a peace officer certified
  1 26 within one year of taking office by the Iowa law enforcement
  1 27 academy under Code chapter 80B and further requires a sheriff
  1 28 to maintain certification while in office.  The bill strikes
  1 29 the exemption from physical training requirements.
