PAG LIN 1 1 Section 1. Section 455F.1, subsection 4, Code 1997, is 1 2 amended to read as follows: 1 3 4. "Household hazardous material" means a product used for 1 4 residential purposes and designated by rule of the department 1 5 of natural resources and may include any hazardous substance 1 6 as defined in section 455B.411, subsection 2; and any 1 7 hazardous waste as defined in section 455B.411, subsection 3; 1 8 and shall include but is not limited to the following 1 9 materials: motor oils, motor oil filters, gasoline and diesel 1 10 additives, degreasers,waxes, polishes,pure solvents, paints, 1 11 with the exception of latex-based paints, lacquers, thinners, 1 12caustic household cleaners, spot and stain remover with1 13petroleum base,and petroleum-based fertilizers. However, 1 14 "household hazardous material" does not include laundry 1 15 detergents or soaps, dishwashing compounds, chlorine bleach, 1 16 personal care products, personal care soaps, cosmetics, and 1 17 medications. 1 18 Sec. 2. Section 455F.3, Code 1997, is repealed. 1 19 EXPLANATION 1 20 This bill amends Code section 455F.1 by removing waxes, 1 21 polishes, caustic household cleaners, and spot and stain 1 22 removers with a petroleum base from the definition of 1 23 household hazardous materials. As a result, these materials 1 24 are not included under the various labeling, permitting, 1 25 collection, and education provisions of Code chapter 455F. 1 26 The bill also changes solvents to pure solvents in the 1 27 definition. 1 28 The bill also repeals Code section 455F.3 relating to a 1 29 labeling requirement for household hazardous materials. 1 30 Currently, that Code section requires the following: 1 31 1. A retailer is required to affix a label near a display 1 32 area of a household hazardous material, in most cases adjacent 1 33 to price information for the material. 1 34 2. The department of natural resources shall develop and 1 35 distribute a list of household hazardous products to be 2 1 utilized in the labeling of display areas. 2 2 3.
