PAG LIN 1 1 Section 1. Section 356.15, Code 1997, is amended to read 1 2 as follows: 1 3 356.15 EXPENSES. 1 4 All charges and expenses for the safekeeping and 1 5 maintenance of prisoners shall be allowed by the board of 1 6 supervisors, exceptthoseas follows: 1 7 1. Prisoners committed or detained by the authority of the 1 8 courts of the United States, in which cases the United States 1 9 must pay such expenses to the county, and those. 1 10 2. Prisoners committed for violation of a city ordinance, 1 11 in which case the city shall pay expenses to the county. 1 12 3. Prisoners for whom a judgment of conviction for a 1 13 public offense which is a class "B", class "C", or class "D" 1 14 felony or an aggravated misdemeanor has been entered, but for 1 15 whom a sentence of confinement has not been imposed under 1 16 section 901.7, because a presentence investigation has been 1 17 ordered under section 901.2, in which case the state shall pay 1 18 expenses to the county. 1 19 Sec. 2. Section 901.7, Code 1997, is amended to read as 1 20 follows: 1 21 901.7 COMMITMENT TO CUSTODY. 1 22 In imposing a sentence of confinement for more than one 1 23 year, the court shall commit the defendant to the custody of 1 24 the director of the Iowa department of corrections. Upon 1 25 entry of judgment and sentence, the clerk of the district 1 26 court immediately shall notify the director of the commitment. 1 27 The court shall make an order as appropriate for the temporary 1 28 custody of the defendant pending the defendant's transfer to 1 29 the custody of the director. The court shall order thecounty1 30where a person was convictedstate topayreimburse the county 1 31 where the person was convicted for the cost of temporarily 1 32 confining the person after entry of judgment and sentence and 1 33 of transporting the person to the state institution where the 1 34 person is to be confined in execution of the judgment. The 1 35 order shall require that a person transported to a state 2 1 institution pursuant to this section shall be accompanied by a 2 2 person of the same sex. 2 3 EXPLANATION 2 4 This bill provides for state reimbursement to the county 2 5 for charges and expenses for the safekeeping and maintenance 2 6 of prisoners who are convicted of, but who have not been sent 2 7 to prison for, class "B", "C", and "D" felony offenses or 2 8 aggravated misdemeanors because the court has ordered a 2 9 presentence investigation. The bill also provides for 2 10 reimbursement to the county of conviction for the costs of 2 11 temporarily confining persons after entry of judgment and 2 12 sentence and transporting the persons for whom a sentence of 2 13 confinement of more than one year has been imposed. 2 14 LSB 1686SC 77 2 15 lh/jw/5
