  1  1    Section 1.  Section 196.8, Code 1997, is amended read as
  1  2 follows:
  1  3    196.8  QUALITY.
  1  4    All eggs offered for sale to an establishment must be no
  1  5 lower than United States department of agriculture consumer
  1  6 grade "B".  Retailers selling eggs at retail must hold eggs at
  1  7 a temperature not to exceed sixty degrees Fahrenheit or
  1  8 sixteen degrees Celsius.  From the time of candling and
  1  9 grading until they reach the consumer, all eggs designated for
  1 10 human consumption shall be held at a temperature not to exceed
  1 11 forty-five degrees Fahrenheit or seven degrees Celsius ambient
  1 12 temperature.  The forty-five degrees Fahrenheit or seven
  1 13 degrees Celsius ambient temperature requirement applies to any
  1 14 place or room in which eggs are stored, except inside a
  1 15 vehicle during transportation where the ambient temperature
  1 16 may exceed forty-five degrees Fahrenheit or seven degrees
  1 17 Celsius, provided the temperature taken inside each egg
  1 18 holding container remains at or below forty-five degrees
  1 19 Fahrenheit or seven degrees Celsius.  All shell eggs shall be
  1 20 kept from freezing.  
  1 21                           EXPLANATION
  1 22    This bill revises the holding temperature required for eggs
  1 23 offered for sale.  Currently, Iowa Code section 196.8 requires
  1 24 a maximum temperature for eggs stored prior to retail sale of
  1 25 60 degrees Fahrenheit or 16 degrees Celsius.  This differs
  1 26 from the United States Food and Drug Administration and United
  1 27 States Department of Agriculture provisions requiring that
  1 28 storage temperatures for eggs shipped interstate must not
  1 29 exceed 45 degrees Fahrenheit or 7 degrees Celsius.  The lower
  1 30 maximum temperature requirement has been imposed on interstate
  1 31 shipping storage based upon the potential for the growth of
  1 32 salmonella enteritidis at higher temperatures.  This bill will
  1 33 extend the interstate requirements to eggs shipped intrastate.
