1 1 Section 1. Section 232.52, subsection 2, paragraph e,
1 2 subparagraph (4), Code 1997, is amended to read as follows:
1 3 (4) The child has previously been placed in a treatment
1 4 facility outside the child's home or in a supervised community
1 5 treatment program established pursuant to section 232.191,
1 6 subsection 4, as a result of a prior delinquency adjudication.
1 7 EXPLANATION
1 8 This bill adds an alternative to the criteria which are
1 9 currently used by the court to determine whether a delinquent
1 10 child may be placed in the state training school or other
1 11 facility. Previous placement in a highly structured
1 12 delinquency day treatment program is added in the bill as an
1 13 alternative to the current requirement that a delinquent child
1 14 must have been previously placed in a treatment facility
1 15 outside the child's home.
