  1  3                  (SUCCESSOR TO SSB 92)
  1  4 A Resolution to provide the senate rules governing
  1  5    lobbyists.
  1  6    BE IT RESOLVED BY THE SENATE, That the senate rules
  1  7 governing lobbyists for the seventy-sixth seventy-
  1  8 seventh general assembly shall be as follows:  
  1  9            SENATE RULES GOVERNING LOBBYISTS
  1 10    1.  DEFINITIONS.  As used in these rules "gift",
  1 11 "honoraria" or "honorarium", "lobbyist", "client", and
  1 12 "immediate family member" have the meaning provided in
  1 13 chapter 68B.  As used in these rules the term
  1 14 "political action committee" means a committee, but
  1 15 not a candidate's committee, which accepts
  1 16 contributions, makes expenditures, or incurs
  1 17 indebtedness in the aggregate of more than two five
  1 18 hundred fifty dollars in any one calendar year for the
  1 19 purpose of supporting or opposing a candidate for
  1 20 public office or ballot issue or influencing
  1 21 legislative action, or an association, lodge, society,
  1 22 cooperative, union, fraternity, sorority, educational
  1 23 institution, civic organization, labor organization,
  1 24 religious organization, or professional or other
  1 25 organization which makes contributions in the
  1 26 aggregate of more than two five hundred fifty dollars
  1 27 in any one calendar year for the purpose of supporting
  1 28 or opposing a candidate for public office or ballot
  1 29 issue or influencing legislative action.
  1 30    2.  APPLICABILITY.  These rules are only applicable
  2  1 to lobbying activities involving the Iowa general
  2  2 assembly.
  2  3    3.  REGISTRATION REQUIRED.  All lobbyists shall, on
  2  4 or before the day their lobbying activity begins,
  2  5 register with the secretary of the senate by filing a
  2  6 lobbyist's registration statement listing the items
  2  7 required under section 68B.36.  In addition, the
  2  8 lobbyist shall file with the secretary of the senate a
  2  9 statement of the general subjects of legislation in
  2 10 which the lobbyist is or may be interested, the
  2 11 numbers of the bills and resolutions (if known) which
  2 12 will be lobbied, and whether the lobbyist intends to
  2 13 lobby for or against each bill (if known).
  2 14    Any change in or addition to the foregoing
  2 15 information shall be registered with the secretary of
  2 16 the senate within ten days after the change or
  2 17 addition is known to the lobbyist.
  2 18    Registration expires upon the commencement of the
  2 19 next regular session of the general assembly, except
  2 20 that the secretary of the senate may adopt and
  2 21 implement a reasonable pre-registration procedure in
  2 22 advance of each regular session during which persons
  2 23 may register for that session and the following
  2 24 legislative interim.
  2 25    4.  CANCELLATION OF REGISTRATION.  If a lobbyist's
  2 26 service on behalf of a particular employer, client, or
  2 27 cause is concluded prior to the end of the calendar
  2 28 year, the lobbyist may cancel the registration on
  2 29 appropriate forms supplied by the secretary of the
  2 30 senate.  Upon cancellation of registration, a lobbyist
  3  1 is prohibited from engaging in any lobbying activity
  3  2 on behalf of that particular employer, client, or
  3  3 cause until reregistering and complying with these
  3  4 rules.  A lobbyist's registration is valid for only
  3  5 one session of a general assembly.
  3  6    5.  LOBBYIST AND CLIENT REPORTING.  Each lobbyist
  3  7 registered with the senate and each lobbyist's client
  3  8 shall file the reports required under sections 68B.37
  3  9 and 68B.38 with the secretary of the senate.
  3 10    For purposes of this rule, and the reports required
  3 11 under sections 68B.37 and 68B.38, "services enumerated
  3 12 under section 68B.2, subsection 13, paragraph "a"" and
  3 13 "lobbying purposes" include, but are not limited to,
  3 14 the following:
  3 15    a.  Time spent by the lobbyist at the state capitol
  3 16 building commencing with the first day of a
  3 17 legislative session and ending with the day of final
  3 18 adjournment of each legislative session as indicated
  3 19 by the journals of the house and senate.
  3 20    b.  Time spent by the lobbyist attending meetings
  3 21 or hearings which results in the lobbyist
  3 22 communicating with members of the general assembly or
  3 23 legislative employees about current or proposed
  3 24 legislation.
  3 25    c.  Time spent by the lobbyist researching and
  3 26 drafting proposed legislation with the intent to
  3 27 submit the legislation to a member of the general
  3 28 assembly or a legislative employee.
  3 29    d.  Time spent by the lobbyist actually
  3 30 communicating with members of the general assembly and
  4  1 legislative employees about current or proposed
  4  2 legislation.
  4  3    6.  GOVERNMENT OFFICIALS.  All federal, state, and
  4  4 local officials or employees representing their
  4  5 departments, commissions, boards, or agencies shall
  4  6 present to the secretary of the senate a letter of
  4  7 authorization from their department or agency heads
  4  8 prior to the commencement of their lobbying.  The
  4  9 lobbyist registration statement of these officials and
  4 10 employees shall not be deemed complete until the
  4 11 letter of authorization is attached.  Federal, state,
  4 12 and local officials who wish to lobby in opposition to
  4 13 their departments, commissions, boards, or agencies
  4 14 must indicate such on their lobbyist registration
  4 15 statements.
  4 16    7.  CHARGE ACCOUNTS AND LOANS.  Lobbyists and the
  4 17 organizations they represent shall not allow any
  4 18 senators to charge any amounts or items to any charge
  4 19 account to be paid for by those lobbyists or by the
  4 20 organizations they represent.  A lobbyist shall not
  4 21 make a loan to a senator unless the loan is made in
  4 22 the ordinary course of business, the lobbyist is in
  4 23 the business of making loans, and the terms and
  4 24 conditions of the loan are the same or substantially
  4 25 similar to the finance charges and loan terms that are
  4 26 available to members of the general public.
  4 27    8.  OFFERS OF ECONOMIC OPPORTUNITY.  A lobbyist, an
  4 28 employer of a lobbyist, or a political action
  4 29 committee shall not offer economic or investment
  4 30 opportunity or promise of employment to any senator
  5  1 with intent to influence the senator's conduct in the
  5  2 performance of official duties.
  5  3    A lobbyist shall not take action intended to
  5  4 negatively affect the economic interests of a senator.
  5  5    For purposes of this rule, supporting or opposing a
  5  6 candidate for office or supporting or opposing a bill,
  5  7 amendment, or resolution shall not be considered to be
  5  8 action intended to negatively affect the economic
  5  9 interests of a senator.
  5 10    9.  MEMBERSHIP CONTRIBUTIONS.  A lobbyist, or
  5 11 employer of a lobbyist, shall not pay for membership
  5 12 in or contributions to clubs or organizations on
  5 13 behalf of a senator.
  5 14    10.  ACCESS TO SENATE FLOOR.  Lobbyists shall not
  5 15 be permitted on the floor of the senate while the
  5 16 senate is in session.  Elected state officials, except
  5 17 the governor, lieutenant governor, and the members of
  5 18 the house of representatives, shall not be permitted
  5 19 on the floor of the senate while the senate is in
  5 20 session to encourage the passage, defeat, or
  5 21 modification of legislation.
  5 22    11.  EFFECTIVE PERIOD.  These rules governing
  5 23 lobbyists shall be in effect throughout the calendar
  5 24 year, whether or not the general assembly is in
  5 25 session.
  5 26    12.  GIFTS.  A lobbyist or the client of a lobbyist
  5 27 shall not, directly or indirectly, offer or make a
  5 28 gift or a series of gifts to a senator, except as
  5 29 otherwise provided in section 68B.22.
  5 30    13.  HONORARIA.  A lobbyist or client of a lobbyist
  6  1 shall not give an honorarium to a member or employee
  6  2 of the senate, except as otherwise provided in section
  6  3 68B.23.
  6  4    14.  COMPLAINTS.  Rules 15 through 23 of the senate
  6  5 code of ethics apply to complaints and procedures
  6  6 regarding violations of these rules.
