PAG LIN 1 1 Section 1. The following amendment to the Constitution of 1 2 the State of Iowa is proposed: 1 3 1. Section 3 of Article III of the Constitution of the 1 4 State of Iowa is repealed and the following adopted in lieu 1 5 thereof: 1 6 REPRESENTATIVES. Sec. 3. The members of the House of 1 7 Representatives shall be chosen every second year, by the 1 8 qualified electors of their respective districts, and their 1 9 term of office shall commence on the first day of January next 1 10 after their election, and continue two years, and until their 1 11 successors are elected and qualified. A person shall not be 1 12 elected for a term as Representative if the term would result 1 13 in more than a total of twelve years of service or six two- 1 14 year terms as a Representative. If a person is elected or 1 15 appointed to serve a portion of a term to which some other 1 16 person was elected or appointed but that person died in office 1 17 or resigned from office or was otherwise removed from office, 1 18 those years served shall not be included in the terms of 1 19 office or total years of service. This limitation on the 1 20 number of terms and the years of service shall only apply to 1 21 terms of office beginning on or after January 1, 2001. 1 22 2. Section 5 of Article III of the Constitution of the 1 23 State of Iowa is repealed and the following adopted in lieu 1 24 thereof: 1 25 SENATORS – QUALIFICATIONS. Sec. 5. Senators shall be 1 26 chosen for a term of four years, at the same time and place as 1 27 Representatives; they shall be twenty-five years of age, and 1 28 possess the qualifications of Representatives as to residence 1 29 and citizenship. A person shall not be elected for a term as 1 30 Senator if the term would result in more than a total of 1 31 twelve years of service or three four-year terms as a Senator. 1 32 If a person is elected or appointed to serve a portion of a 1 33 term to which some other person was elected or appointed but 1 34 that person died in office or resigned from office or was 1 35 otherwise removed from office, those years served shall not be 2 1 included in the terms of office or total years of service. 2 2 This limitation on the number of terms and the years of 2 3 service shall only apply to terms of office beginning on or 2 4 after January 1, 2001. 2 5 3. Section 2 of Article IV of the Constitution of the 2 6 State of Iowa, as amended by amendment number 1 of the 2 7 Amendments of 1972 and amendment number 1 of the Amendments of 2 8 1988, is repealed and the following adopted in lieu thereof: 2 9 ELECTION AND TERM. Sec. 2. The Governor and the 2 10 Lieutenant Governor shall be elected by the qualified electors 2 11 at the time and place of voting for members of the General 2 12 Assembly. Each of them shall hold office for four years from 2 13 the time of installation in office and until a successor is 2 14 elected and qualifies. A person shall not be elected Governor 2 15 or Lieutenant Governor if the term would result in more than a 2 16 total of twelve years of service or three four-year terms in 2 17 either office. If a person is elected or appointed to serve a 2 18 portion of a term to which some other person was elected or 2 19 appointed but that person died in office or resigned from 2 20 office or was otherwise removed from office, those years 2 21 served shall not be included in the terms of office or total 2 22 years of service. This limitation on the number of terms and 2 23 the years of service shall only apply to terms of office 2 24 beginning on or after January 1, 2001. 2 25 4. Section 22 of Article IV of the Constitution of the 2 26 State of Iowa, as amended by amendment number 1 of the 2 27 Amendments of 1972, is repealed and the following adopted in 2 28 lieu thereof: 2 29 SECRETARY – AUDITOR – TREASURER. Sec. 22. A Secretary 2 30 of State, an Auditor of State, and a Treasurer of State shall 2 31 be elected by the qualified electors at the same time that the 2 32 Governor is elected and for a four-year term commencing on the 2 33 first day of January next after their election, and they shall 2 34 perform such duties as may be provided by law. A person shall 2 35 not be elected Secretary of State if the term would result in 3 1 more than a total of twelve years of service or three four- 3 2 year terms as Secretary of State. A person shall not be 3 3 elected Auditor of State if the term would result in more than 3 4 a total of twelve years of service or three four-year terms as 3 5 Auditor of State. A person shall not be elected Treasurer of 3 6 State if the term would result in more than a total of twelve 3 7 years of service or three four-year terms as Treasurer of 3 8 State. If a person is elected or appointed to serve a portion 3 9 of a term to which some other person was elected or appointed 3 10 but that person died in office or resigned from office or was 3 11 otherwise removed from office, those years served shall not be 3 12 included in the terms of office or total years of service. 3 13 This limitation on the number of terms and the years of 3 14 service shall only apply to terms of office beginning on or 3 15 after January 1, 2001. 3 16 5. Section 12 of Article V of the Constitution of the 3 17 State of Iowa, as amended by amendment number 1 of the 3 18 Amendments of 1972, is repealed and the following adopted in 3 19 lieu thereof: 3 20 ATTORNEY GENERAL. Sec. 12. The General Assembly shall 3 21 provide, by law, for the election of an Attorney General by 3 22 the people, whose term of office shall be four years, and 3 23 until a successor is elected and qualifies. A person shall 3 24 not be elected Attorney General if the term would result in 3 25 more than a total of twelve years of service or three four- 3 26 year terms as Attorney General. If a person is elected or 3 27 appointed to serve a portion of a term to which some other 3 28 person was elected or appointed but that person died in office 3 29 or resigned from office or was otherwise removed from office, 3 30 those years served shall not be included in the terms of 3 31 office or total years of service. This limitation on the 3 32 number of terms and the years of service shall only apply to 3 33 terms of office beginning on or after January 1, 2001. 3 34 Sec. 2. The foregoing amendment to the Constitution of the 3 35 State of Iowa is referred to the General Assembly to be chosen 4 1 at the next general election for members of the General 4 2 Assembly and the Secretary of State is directed to cause the 4 3 same to be published for three consecutive months previous to 4 4 the date of that election as provided by law. 4 5 EXPLANATION 4 6 This joint resolution proposes an amendment to the 4 7 Constitution of the State of Iowa to provide that members of 4 8 the Iowa house of representatives shall not serve more than 4 9 six terms or 12 years as a representative and that members of 4 10 the Iowa senate shall not serve more than three terms or 12 4 11 years as a senator. If a person serves a portion of a term to 4 12 which some other person was elected or appointed, the partial 4 13 term shall not be included in the number of terms or total 4 14 years of service. The limitation on the number of terms and 4 15 the years of service shall only apply to terms of office 4 16 beginning on or after January 1, 2001. 4 17 The amendment also provides that persons elected to the 4 18 office of governor, lieutenant governor, attorney general, 4 19 secretary of state, auditor of state, and treasurer of state 4 20 are limited to three terms or 12 years in each office. If a 4 21 person serves a portion of a term to which some other person 4 22 was elected or appointed, the partial term shall not be 4 23 included in the number of terms or total years of service. 4 24 The limitation on the number of terms and the years of service 4 25 shall only apply to terms of office beginning on or after 4 26 January 1, 2001. 4 27 The resolution, if adopted, would be referred to the next 4 28 general assembly before being submitted to the electorate for 4 29 ratification. 4 30 LSB 1023SS 77 4 31 sc/sc/14
