1 4 RELATING TO THE PROHIBITION OF SEX ACTS BETWEEN JUVENILES AND
1 5 EMPLOYEES AND AGENTS AT JUVENILE PLACEMENT FACILITIES AND
1 6 BETWEEN PRISONERS INCARCERATED IN A COUNTY JAIL AND EMPLOYEES
1 7 OR AGENTS OF A COUNTY AND PROVIDING A PENALTY.

1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 11 Section 1. Section 709.16, Code 1997, is amended to read
1 12 as follows:
1 13 709.16 SEXUAL MISCONDUCT WITH OFFENDERS AND JUVENILES.
1 14 1. An officer, employee, contractor, vendor, volunteer, or
1 15 agent of the department of corrections, or an officer,
1 16 employee, or agent of a judicial district department of
1 17 correctional services, who engages in a sex act with an
1 18 individual committed to the custody of the department of
1 19 corrections or a judicial district department of correctional
1 20 services commits an aggravated misdemeanor.
1 21 2. An officer, employee, contractor, vendor, volunteer, or
1 22 agent of a juvenile placement facility who engages in a sex
1 23 act with a juvenile placed at such facility commits an
1 24 aggravated misdemeanor.
1 25 For purposes of this subsection, a "juvenile placement
1 26 facility" means any of the following:
1 27 a. A child foster care facility licensed under section
1 28 237.4.
1 29 b. Institutions controlled by the department of human
1 30 services listed in section 218.1.
1 31 c. Juvenile detention and juvenile shelter care homes
1 32 approved under section 232.142.
1 33 d. Psychiatric medical institutions for children licensed
1 34 under chapter 135H.
1 35 e. Substance abuse facilities as defined in section 125.2.
2 1 3. An officer, employee, contractor, vendor, volunteer, or
2 2 agent of a county who engages in a sex act with a prisoner
2 3 incarcerated in a county jail commits an aggravated
2 4 misdemeanor.
