1 1 Section 1. Section 805.8, subsection 2, paragraph k, Code
1 2 Supplement 1997, is amended to read as follows:
1 3 k. For violations by operators of school buses and
1 4 emergency vehicles, and for violations by other motor vehicle
1 5 operators when in vicinity, under sections 321.231, 321.324,
1 6 and 321.372, subsections 1 and 2, the scheduled fine is
1 7 twenty-five dollars. For violations of section 321.372,
1 8 subsection 3, the scheduled fine is fifty dollars.
1 9 For violations by operators of school buses under section
1 10 321.285, the scheduled fine is twenty-five dollars. However,
1 11 excessive speed by a school bus in excess of ten miles over
1 12 the limit is not a scheduled violation.
1 13 EXPLANATION
1 14 Current law provides that an operator of a motor vehicle
1 15 who does not stop when the stop signal arm is extended on a
1 16 school bus shall receive a scheduled fine of $25. In
1 17 addition, if an operator does not reduce a vehicle's speed and
1 18 come to a complete stop when just the red or amber warning
1 19 lights are flashing on a school bus the operator shall also
1 20 receive a scheduled fine of $25.
1 21 This bill increases the scheduled fine to $50 for an
1 22 operator who either fails to stop when the stop signal arm is
1 23 extended on a school bus or fails to stop when flashing
1 24 warning lights are activated on a school bus.
