1 1 Section 1. NEW SECTION. 904.517 INMATE GROOMING
1 2 STANDARDS.
1 3 1. The department shall adopt rules establishing personal
1 4 grooming standards for inmates of the institutions under the
1 5 control of the director. Rules adopted shall include, but
1 6 shall not be limited to, the following standards:
1 7 a. A standard which prohibits an inmate from using the
1 8 inmate's hair or scalp to display gang or political
1 9 affiliations.
1 10 b. A standard which prohibits an inmate from changing the
1 11 inmate's natural hair color or wearing any nonapproved wig or
1 12 hairpiece.
1 13 c. A standard which limits the length of a male inmate's
1 14 scalp hair to three inches and which restricts the size and
1 15 length of facial hair as follows:
1 16 (1) Mustaches must extend to the corners of the mouth and
1 17 cannot extend more than one-quarter of an inch beyond the
1 18 corners of the mouth.
1 19 (2) Whiskers cannot be longer than the top of the inmate's
1 20 upper lip.
1 21 d. A standard which requires a female inmate to use an
1 22 approved hair-holding device if the inmate's hair falls below
1 23 the inmate's shirt collar, and which prohibits the wearing of
1 24 beads or similar ornaments in the inmate's hair.
1 25 e. A standard which limits the length of an inmate's
1 26 fingernails to no more than one quarter of an inch beyond the
1 27 end of the fingers and prohibits the use of colored nail
1 28 polish by an inmate.
1 29 f. A standard which prohibits an inmate from piercing or
1 30 allowing another inmate to pierce any part of the inmate's
1 31 body.
1 32 g. A standard which limits the wearing of earrings by male
1 33 and female inmates by prohibiting male inmates from possessing
1 34 or wearing earrings and restricting female inmates to wearing
1 35 one institutionally approved earring in each ear.
2 1 h. A standard which limits the use of cosmetics and false
2 2 eyelashes by inmates.
2 3 2. A person who is committed to the custody of the
2 4 director of the department shall comply with the grooming
2 5 standards established by the department and shall submit to a
2 6 daily visual inspection to determine the inmate's compliance
2 7 with the standards. At the time that a person is initially
2 8 brought to an institution under the department of corrections,
2 9 the person shall be informed of the applicable grooming
2 10 standards and provided the opportunity to comply prior to
2 11 being photographed. Failure to comply with the standards
2 12 established pursuant to this section shall be grounds for
2 13 disciplinary action under the disciplinary rules of the
2 14 institution to which an inmate is committed.
2 15 EXPLANATION
2 16 This bill requires the department of corrections to adopt
2 17 rules which establish personal grooming standards for the
2 18 inmates of the institutions under the control of the director
2 19 of the department of corrections. At the time that a person
2 20 is initially brought to an institution, the person is to be
2 21 informed of the applicable grooming standards and provided the
2 22 opportunity to comply prior to being photographed. An inmate
2 23 who does not comply with the standards is to be disciplined
2 24 according to the rules of the institution to which the inmate
2 25 is committed.
2 26 The bill provides that the standards are to include, but
2 27 are not limited to, standards which relate to scalp and facial
2 28 hair length and color, use of hair and scalp to display gang
2 29 or political affiliation, fingernail length and color, earring
2 30 use, use of cosmetics and false eyelashes, and body piercing.
2 31 Inmates are required under the bill to submit to visual
2 32 daily inspection to determine compliance with the standards.
