  1  4 RELATING TO ANATOMICAL GIFTS BY MODIFYING CERTAIN
  1  5    QUALIFICATION REQUIREMENTS FOR HOSPITAL REIMBURSEMENT
  1  6    GRANTS AND REQUIRING SUBMISSION OF AN ANNUAL DONATION
  1  7    AND COMPLIANCE REPORT.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1 10 
  1 11    Section 1.  Section 142C.15, subsection 4, paragraphs b and
  1 12 c, Code 1997, are amended to read as follows:
  1 13    b.  Not more than thirty percent of the moneys in the fund
  1 14 annually may be expended in the form of grants to hospitals
  1 15 for reimbursement for costs directly related to the
  1 16 development of in-hospital anatomical gift public awareness
  1 17 projects, anatomical gift referral protocols, and associated
  1 18 administrative expenses.  As a condition of receiving a grant,
  1 19 a hospital shall demonstrate, through documentation, that the
  1 20 hospital, during the previous calendar year, properly complied
  1 21 with in-hospital anatomical gift request protocols for at
  1 22 least eighty percent of all deaths occurring in the hospital
  1 23 at a percentage rate which places the hospital in the upper
  1 24 fifty percent of all protocol compliance rates for hospitals
  1 25 submitting documentation for cost reimbursement under this
  1 26 section.
  1 27    c.  Not more than fifty percent of the moneys in the fund
  1 28 annually may be expended in the form of grants to hospitals
  1 29 which perform heart, lung, liver, pancreas, or kidney
  1 30 transplants.  As a condition of receiving a grant, a hospital
  1 31 shall demonstrate, through documentation, that the hospital,
  1 32 during the previous calendar year, properly complied with in-
  1 33 hospital anatomical gift request protocols for at least eighty
  1 34 percent of all deaths occurring in the hospital at a
  1 35 percentage rate which places the hospital in the upper fifty
  2  1 percent of all protocol compliance rates for hospitals
  2  2 submitting documentation for cost reimbursement under this
  2  3 section.  The hospital shall submit an application on behalf
  2  4 of a patient requiring a transplant in the amount of the costs
  2  5 associated with the following, if funds are not available from
  2  6 any other third-party payor:
  2  7    (1)  The costs of the organ transplantation procedure.
  2  8    (2)  The costs of post-transplantation drug or other
  2  9 therapy.
  2 10    (3)  Other transplantation costs including but not limited
  2 11 to food, lodging, and transportation.
  2 12    Sec. 2.  NEW SECTION.  142C.17  ANNUAL DONATION AND
  2 13 COMPLIANCE REPORT.
  2 14    The Iowa department of public health, in conjunction with
  2 15 any statewide organ procurement organization in Iowa, shall
  2 16 prepare and submit a report to the general assembly on or
  2 17 before January 1 each year regarding organ donation rates and
  2 18 voluntary compliance efforts with hospital organ and tissue
  2 19 donation protocols by physicians, hospitals, and other health
  2 20 systems organizations.  The report shall contain the
  2 21 following:
  2 22    1.  An evaluation of organ procurement efforts in the
  2 23 state, including statistics regarding organ and tissue
  2 24 donation activity as of September 30 of the preceding year.
  2 25    2.  Efforts by any statewide organ procurement organization
  2 26 in Iowa, and related parties, to increase organ and tissue
  2 27 donation and consent rates.
  2 28    3.  Voluntary compliance efforts with hospital organ and
  2 29 tissue donation protocols by physicians, hospitals, and health
  2 30 systems organizations and the results of those efforts.
  2 31    4.  Annual contribution levels to the anatomical gift
  2 32 public awareness and transplantation fund created in section
  2 33 142C.15, and any distributions made from the fund.
  2 34    5.  Efforts and ideas for increasing public awareness of
  2 35 the option of organ and tissue donation.
  3  1    6.  Additional information deemed relevant by the
  3  2 department in assessing the status and progress of organ and
  3  3 tissue donation efforts in the state.
