  1  4 PROVIDING FOR EXCEPTIONS TO MUNICIPAL TORT LIABILITY FOR
  1  5    SKATEBOARDING AND IN-LINE SKATING.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 670.4, Code 1997, is amended by adding
  1 10 the following new subsections:
  1 11    NEW SUBSECTION.  14.  Any claim based upon or arising out
  1 12 of a claim of negligent design or specification, negligent
  1 13 adoption of design or specification, or negligent construction
  1 14 or reconstruction of a public facility designed for purposes
  1 15 of skateboarding or in-line skating that was constructed or
  1 16 reconstructed in accordance with a generally recognized
  1 17 engineering or safety standard, criteria, or design theory in
  1 18 existence at the time of the construction or reconstruction.
  1 19    NEW SUBSECTION.  15.  Any claim based upon or arising out
  1 20 of an act or omission of an officer or employee of the
  1 21 municipality or the municipality's governing body by a person
  1 22 skateboarding or in-line skating on public property when the
  1 23 person knew or reasonably should have known that the
  1 24 skateboarding or in-line skating created a substantial risk of
  1 25 injury to the person and was voluntarily in the place of risk.
  1 26 The exemption from liability contained in this subsection
  1 27 shall only apply to claims for injuries or damage resulting
  1 28 from the risks inherent in the activities of skateboarding or
  1 29 in-line skating.
